July 25, 2023 William White Befesa Zinc Metal LLC Email: william.white@befesa.com SUBJECT: Bioassay Compliance Inspection Report Befesa Zinc Metal, LLC NPDES WW Permit No. NC0089109 Rutherford County Dear Permittee: The North Carolina Division of Water Resources conducted a Bioassay Compliance Inspection of Befesa Zinc Metal on July 11, 2023 and July 13, 2023. This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES WW Permit No. NC0089109. The test resulted in a fail from both our Bioassay Laboratory in Raleigh and ETT Environmental. Findings noted during this inspection are provided in the enclosed copy of the inspection report. Whole Effluent samples were split with the assistance of Blake Hoyle and Bryon Shull for use in a chronic Ceriodaphnia dubia pass-fail toxicity test. The toxicity test failed for both the Division's sample (analyzed by our Bioassay Laboratory in Raleigh) and Befesa Zinc's sample (analyzed by ETT Environmental). Toxicity test information follows: Test Type: 3-Brood Ceriodaphnia dubia chronic pass-fail Test Result: Fail Test Concentration: 0.9% Control Survival: 100% Control Mean Reproduction: NA (test terminated early due to treatment mortality) Test Treatment Survival: 0% Treatment Mean Reproduction: 0 neonates First Sample pH: 6.41 SU First Sample Conductivity: 45.3 mS/cm First Sample Total Residual Chlorine: <0.5 mg/L Second Sample pH: 7.14 SU Second Sample Conductivity: 43.3 mS/cm Second Sample Total Residual Chlorine: <0.5 mg/L Test results from the above samples indicate that the effluent would be predicted to have water quality impacts. Per NPDES Permit NC0089109, Part I, Section (A.) (2.), multiple-concentration toxicity testing should be performed at a minimum in each of the two months following the failed toxicity test.
