Good afternoon,
In accordance with 15A NCAC 02B .0611 and 15A NCAC 02B .0714 the Division shall evaluate if the proposed
activity: has avoided and minimized impacts to riparian buffers for the proposed activity. The DWR is placing your
application on hold until such time as the following requested additional information has been provided to complete
the review:
1) A copy of the encroachment agreement with ACOE for the channel right-of-way (ROW).
2) Site plans showing the location of the USACE ROW and the proposed pool.
3) A site visit can be conducted to verify the riparian buffer impacts.
Please note, DWR received the Buffer Authorization Application Form as required by 15A NCAC 02B .0611 and 15A NCAC
02B .0714 on 5/19/2023 which started the 60-day State review clock, additional information is requested on 7/14/2023,
once additional information is received the 60-day state clock will re -start. If you have any questions, please feel free to

Buzz signed an encroachment agreement last week with ACOE. We should have confirmation soon. Justin may be able
to confirm so that we can continue the DWR process.
