This is the same project for which you received an application package for your review and comment by certified mail on June 27, 2022. The purpose of the modified application is to address concerns raised by the Division of Water Resources (DWR) and to provide additional requested information. The Major CAMA/Dredge and Fill application has been on hold pending official submittal of these proposed changes. The modifications to the original project design and implementation concern mainly Boat Harbor Canal (BHC). The changes to excavation of BHC include a reduction in the depth and width of the proposed excavation from an originally proposed final depth of -6.0' below the Normal Water Level (NWL) to -5.0' and from an originally proposed average widening of BHC from 21.5' to 16.5' maintaining a distance of 65' off the northern boundary line in BHC. The purpose of these changes is to address concerns raised by DWR with the flushing of BHC. There is also a proposed reduction in excavation within Battalina Creek and reduction in length of dock "C". Also bottom sediment sampling is proposed to assess the potential presence of contaminants. The specifics of the proposed changes are in the enclosed application forms and drawings. As the adjacent riparian property owner to the aforementioned project, I am required to notify you of the development to give you the opportunity to comment on the project as part of a prescribed environmental permit process administered by the NC Division of Coastal Management (NCDCM). Please review the attached permit application and drawings. Should you have any objections or comments concerning these proposed changes, please send your written comments to Mr. Kelly Spivey, DCM District Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC 27889, within 30 days of your receipt of this notice. Such comments will be considered by the Department in reaching a final decision on the application. No comment within 30 days of your receipt of this notice will be considered as no objection.
