8. PROJECT SUMMARY:
The applicant proposes to install a new bulkhead/retaining wall with approximately 71 sq. ft. of
Coastal Wetland fill adjacent to an existing single-family home.
9. NARRATIVE DESCRIPTION:
The project site is located at 342 Caswell Beach Rd., adjacent to the Elizabeth River and the
AIWW, in the Town of Caswell Beach, Brunswick County.
The parcel at the project location is approximately 0.34 acres. The lot has an existing single-
family residence and backs up to land owned by the Town of Caswell Beach. The project site
has approximately 75' of area on the northern property line which consists of both Coastal
Wetlands and Section 404 Wetlands. The parcel is not riparian and NHW is approximately 65-
110 ft. waterward of the property line. The Coastal Wetland Area has been mowed consistently
to within a few feet of the back deck of the single-family home and consists of crab holes, Salt
Meadow Grass (Spartina patens) and Spike Grass (Distichlis sp). There is an existing retaining
wall on the property to the west, but the adjacent property to the east has not been stabilized.
Adjacent marsh areas located below NHW are owned by The State of NC. No permit history
was found for this property. The property is bordered by residential lots with single family
homes to the west and east, vacant land and marsh to the north and Caswell Beach Road to the
south.
The Town of Caswell Beach Land Use Plan classifies the adjacent waters as Developed and
Conservation, and the adjacent high ground portion of the project area as Residential. The
adjacent waters of Piney Point Creek in the project area are classified SC-HQW by the
Division of Water Resources and this area IS designated as Primary Nursery Area (PNA) by
the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
10. PROJECT DESCRIPTION:
The applicant proposes to install a new bulkhead/retaining wall with approximately 71 sq. ft. of
Coastal Wetland fill adjacent to an existing single-family home.
According to the applicant, a new bulkhead/retaining wall is proposed to protect a single-
family home from storm surge and high water. The current back deck of the house is
approximately 2-3 ft. landward of the Coastal Wetland line and the proposed bulkhead would
be approximately 6.5 ft. waterward of the existing back deck, partially within the Estuarine
Shoreline AEC. Approximately 71 sq. ft. of Coastal Wetlands would be impacted with the
proposed alignment (see Page 1 of 4). The bulkhead/retaining wall would tie into an existing
bulkhead/retaining wall to the west and a 30 ft. return wall would be constructed on the eastern
property line. The Town of Caswell Beach was notified of the proposed development and has
indicated that they have no objection to this proposal. The application states that wetlands on
the property were reviewed by the USACE on May 24, 2023.

The proposed new bulkhead/retaining wall would result in the filling of approximately 71 sq. ft.
of high marsh Coastal Wetland species, consisting primarily of Salt Meadow Grass (Spartina
patens) and Spike Grass (Distichlis sp). Approximately 1,500 sq. ft. of high ground would be
disturbed, partially within the Estuarine Shoreline AEC. It appears that the wetland areas are
migrating landward toward the single-family home structure, some of this could be a result of
continuous marsh mowing.

Applicants, Mike and Lucinda Harmon, of 342 Caswell Beach Road in Caswell Beach, NC are
proposing to install a new bulkhead adjacent to marsh area. The bulkhead alignment being
proposed will fill approx. 71 sq. ft. of coastal wetland vegetation (bulrush) and avoid all 404
wetland areas. The siting of the new bulkhead to be installed navy style with anchor supports
will provide adequate spacing from the existing home and deck which are 6.5' landward of the
proposed bulkhead alignment. In order to get a straight alignment and not undermine the
compacted soil under the existing deck a section of sparce bulrush is proposed to be filled. The
vinyl bulkhead will be designed to maintain the lot's integrity is storm surge and high water.

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted for development permits in Areas of Environmental
Concern as designated under the CAMA: On July 25, 2023, Mark Harmon proposed to install a new
bulkhead/retaining wall with approx. 71 sq. ft. of* Coastal Wetland fill at 342 Caswell Beach Rd., adj. to the

RECOMMENDATIONS FOR 342 Caswell Beach Road
7/25/23
The proposed new bulkhead/retaining wall would result in the permanent filling of approximately 71 sq. ft. of
high marsh Coastal Wetland Area. The current location of the structure is approximately 2-3 ft. from the
back deck to the Coastal Wetland Line. The siting of the new bulkhead/retaining wall (6.5 ft. waterward of
the existing deck) would provide adequate spacing from the existing home and deck to get a straight
alignment and not undermine the compacted soil under the existing deck. It appears that the project could
be consistent with the use standards set forth in NCAC 07H .0205(d) Use Standards for Coastal Wetlands
as the applicant is minimizing wetland impacts in order to stabilize land area directly adjacent to an existing
single-family home structure.
As proposed, this office has no objections to the proposed project.
