Dear Ms. Isenhower:
On June 30, 2023, the Division of Water Resources (Division) received your application requesting an
Individual Water Quality Certification from the Division for the subject project. The Division has
determined that your application is incomplete and cannot be processed. The application is on -hold
until all of the following information is received:
There appear to be a number of direct impacts associated with the project that are not included in
the impact table. Please revise the impact table to include the following or explain why these are
not included as impacts. If determined to be impacts, please also include information detailing how
excavation in flowing water will be avoided during installation of these features. If there is any
question as to whether the items noted below are impacts, please confer with the US Army Corps of
Engineers.
Construction detail 4/L8.8 for the River Bank Boulder Toe on Site Elements Sheet L8.8
depicts the footer boulder associated with this feature installed below the elevation
of the river bed and subsequent boulders below the water line. The Division asked
about this area during a review of the previous application and the response
indicated the feature would be constructed above the ordinary high water mark.
b. There are two locations where boulder stepping stones are proposed within the
unnamed tributary (UT) of the French Broad River running through the central
portion of the project area. These features are called out on the Materials Plan Sheet
L4.3 and construction details may be found on the Paving and Circulation Sheet L8.1.
c. The Utility Layout Plan Sheet C2.0 depicts a water line crossing the UT to the French
Broad River. Construction detail W.27 on the Water Utility Details Sheet C5.0 depicts

the water line installed below the streambed elevation with references to restoring
the streambank indicating the utility will be trenched -in at this location.
Please note, if this is determined to be an impact, the Division typically requires
utility line installations across streams be installed by implementing the selected
stream flow diversion; excavating and segregating the native streambed material;
installing the utility; backfilling with desired backfill and restoring the original grade
with the native streambed material; restoring the streambanks to a stable slope;
seeding the streambanks with a native riparian seed mix; mulching the streambanks;
and matting the streambanks using a 100% biodegradable matting. Detail W.27
depicts the streambed restored with rip rap and the streambank restored using
native stone or rip rap. If determined to be an impact, please revise detail W.27 as
described above, or explain why this method of stream restoration is not practicable.
2. During review of the previous application, the Division repeatedly expressed concerns about the
mud play area, and the potential degradation of the UT to the French Broad River in proximity to
this area. During a recent conference call, Division staff were told this area was removed from the
project. However, rather than removing this area from the project, it appears the name was
removed, but the elements remain. Please revise the plans to relocate the mud kitchen to another
area of the site or explain why relocation is not feasible/practicable.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested information
to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by
submitting all of the above requested information through this
link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on
the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be denied as incomplete. The denial of this
project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
