Hi Andrew, I am having an issue with cookies preventing me from accessing that agent authorization letter. I have attached an older version I have used. Will this suffice? If so, I'll get that signed ASAP. In regards to: All work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact with the disturbed area. Approved best management practices from the most current version of the NC Sediment and Erosion Control Design Manual or the NC Department of Transportation Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams, or other diversion structures shall be used to minimize excavation in flowing water. Please provide a construction sequence, or describe the method to be employed, to ensure the flowing stream does not come in contact with the disturbed area. [15A NCAC 02H .0506(b)(2) and (3)] The contractor will utilize your requested BMPs to prevent the flowing stream from contacting the disturbed area. I will advise the use of sandbags, rock berms, cofferdams, or other diversion structures shall be used to minimize excavation in flowing water. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: Title 15A NCAC 02H .0502(a)(11) requires that if an agent signs the application, an agent authorization letter must be provided. Please provide an agent authorization form signed by the project owners granting you signature authority. Please provide your response by August 11, 2023. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
