Notice of Violation – Springdale Resort – Haywood Co.
Mr. Brown,
PR Engineering, PLLC (PRE) has been working closely with Springdale Resort in efforts to
resolve the notice of violation at parcel PIN#8663-59-2373 involving the unauthorized impacts
to the unnamed tributaries of Long Branch. PRE has provided erosion control plans outlining
corrective measures required to bring the site as closely back as possible to pre-existing
conditions.
On March 18, 2022, Springdale Resort completed the corrective action plan designed by PRE
and reviewed by Haywood County Development Services Specialist Tim Surrett. Both plans and
photos are provided in this submittal.
It is the intent of PRE and Springdale resort to present back to the ACOE by Fall of this year, a
new revised site plan that identifies relocation of the stream that will entail piping in sections of
the stream along with stream restoration of the sections that remain open. Proper permit
applications will also be filed at this time.
Should your office require any additional information in this request to resolve and ultimately
release the notice of violation please do not hesitate to contact us should you have any questions
or concerns.

See silt fence maintenance requirements.
Maintenance
Inspect compost socks weekly and after each significant
rainfall event (1/2 inch or greater). Remove
accumulated sediment and any debris.
The compost sock must be replaced if clogged or torn.
If ponding becomes excessive, the sock may need to be
replaced with a larger diameter or a different measure.
The sock needs to be reinstalled if undermined or
dislodged.
The compost sock shall be inspected until land
disturbance is complete and the area above the
measure has been permanently stabilized.
Maintenance
Maintain the gravel pad in a condition to prevent mud
or sediment from leaving the construction site. This
may require periodic topdressing with 2-inch stone.
After each rainfall, inspect any structure used to trap
sediment and clean it out as necessary. Immediately
remove all objectionable materials spilled, washed, or
tracked onto public roadways.
Maintenance
Inspect temporary diversions once a week and after
every rainfall. Immediately remove sediment from the
flow area and repair the diversion ridge. Carefully
check outlets and make timely repairs as needed. When
the area protected is permanently stabilized, remove
the ridge and the channel to blend with the natural
ground level and appropriately stabilize it.
Maintenance
Periodically check the seeded slopes for rills and
washes. Fill these areas slightly above the original
grade, then reseed and mulch as soon as possible.

Inspect Rolled Erosion Control Products at least weekly
and after each significant (1/2 inch or greater) rain fall
event repair immediately.
Good contact with the ground must be maintained, and
erosion must not occur beneath the RECP.
Any areas of the RECP that are damaged or not in close
contact with the ground shall be repaired and stapled.
If erosion occurs due to poorly controlled drainage, the
problem shall be fixed and the eroded area protected.
Monitor and repair the RECP as necessary until ground
cover is established.
Maintenance
Inspect check dams and channels at least weekly and
after each significant (1/2 inch or greater) rainfall
event and repair immediately. Clean out sediment,
straw, limbs, or other debris that could clog the
channel when needed.
Anticipate submergence and deposition above the
check dam and erosion from high flows around the
edges of the dam. Correct all damage immediately.
If signficant erosion occurs between dams, addtional
measures can be taken, such as installing a
protective riprap liner in that portion of the channel
(Re: Practice 6.31, Riprap-line and Paved Channels).
Remove sediment accumulated behind the dams as
needed to prevent large flows from carrying
sediment over the dam. Add stones to dams as
needed to maintain design height and cross section.
