Do you have availability next Tuesday or Wednesday at 9:00 AM to meet onsite?
Attached is the last email correspondence I had with David. We submitted for option two in the NOV letter which was a
corrective action plan addressing the unauthorized work / flood cleanup of the area. This plan / work was completed in
mid‐March; however not formally submitted to David until July 11th for various reasons that we can discuss if it is of
importance. I’m unclear as to why this did not dissolve the NOV but instead David further asked for Springdale to
submit the applicable permit applications for the proposed plan of the stream by November 18, 2022. I don’t suppose it
really mattered because the intent from the beginning was always to submit for the applicable permits once a site plan
was established. When all remedial work was completed in mid‐March, PR Engineering began working with Springdale
on developing a full set of plans for the proposed extension of the driving range which is where we are at today. The
site has mostly sat idle since April. Springdale has hired a contractor to complete the work who has also mobilized
equipment to the site to begin once we resolve the stream matter.

I believe an onsite meeting would be good with all of the agencies because I think we are all going in circles. I am also
trying to get in touch with David to discuss the history so I can not go against something he told you. I am available most

Thank you for your response in this project. You are correct, this area has been issued an NOV (by several
agencies). However, in terms of progress it appears that we are moving in circles and don’t seem to be on the same
page regarding timeline, past history, and expected deliverables previously requested by your predecessor. I realize
communication can get lost in transition of power but assumed this information would have been transferred with
changing of positions. I would like to request an in‐person meeting to discuss past project correspondence, current
project status, and what the understanding of our team has been since January 31, 2022 and in working with Springdale
Resort. This way you can advise on how you wish us to proceed if different from the previous. We can come to your
office or meet in the field. Please let me know what days you have available and what is most convenient for

I apologize for the delay in response concerning this proposed project, between the holidays and me being sick, I was
not able to visit the site until last week and dig further into the history of this site.
Based on my site visit, the channel was flowing‐and had a layer of ice accumulation along the sides, which is indicative of
at the least, an intermittent channel, but most likely perennial. I also noted that it was roughly at least 1‐2 feet in width
throughout at the ordinary high water mark, which would mean the 770’ of impacts would equate to at least 0.03‐
acre. Also, this area was part of a NOV and corrective action plan area to restore 0.1‐acre of wetlands, open water, and
stream impacts, which is different than what was relayed to me during our telephone conversation. I do not see
anywhere in the file where we stated you could restore, permit and turn around and impact this area, especially without
mitigation. Nor do I see that wetlands and/or open water were restored. Please advise.

Good Morning Brooke,
We appreciate you taking the time to discuss this project with us last week. At your request we have reviewed the
project plans and offer the feedback in the attached letter. As discussed, our original PCN submittal incorrectly stated
stream widths in which the online portal would not allow us to correct the submittal. A new PCN has been submitted,
with the correct stream impacts of .014 acres (this is a conservative estimate). I hope this clears up confusion from the
group and everyone sees the impacts are substantially less than what was displayed on the original PCN. Please also
note, a prefiling notification request was made on November 9, 2022.
Please let me know if you have additional items to be addressed in this request. Thank you,
