with the RES Cape Fear 05 Umbrella Mitigation Bank, Dugout Mitigation Site

Dear Mr. Carroll:

This letter is to inform you that the Wilmington District, Corps of Engineers (Corps)
has reviewed the as-built baseline monitoring report for the RES Cape Fear 05
Umbrella Mitigation Bank (UMB), Dugout mitigation site (Action ID SAW-2018-01883),
dated March 10, 2023, and revised on June 30, 2023. The Dugout site is in the Cape
Fear River Basin (Hydrologic Unit Code 03030005), southeast of the intersection of Hwy
87 and Upton Tyson Road, adjacent to Grays Creek, in Cumberland County, NC.

In accordance with Sec. 332.8(o)(9) of the Federal Mitigation Rule, the baseline
monitoring report was provided to the North Carolina Interagency Review Team
(NCIRT) for review and comment on March 21, 2023. A site meeting was also held on
May 30, 2023, to assess the as-built site conditions. During this meeting, the NCIRT
noted several actions that had to be completed prior to the approval of the as-built plans
and associated credit release. The two major items included submittal of a plan to
modify (reconstruct) and monitor reach TV1-C and revising the wetland credit
calculations to remove constructed floodplain swales from wetland credit (a reduction of
0.042 credits). The attached minutes document result of the meeting and comments
from the NCIRT. Following the meeting, the revised as-built baseline monitoring report
dated June 30, 2023, was submitted to our office, which verifies completion of the
required actions necessary to finalize the as-built report.

Pursuant to the UMB Instrument approved on September 29, 2021, and the site-
specific Dugout Final Mitigation Plan dated April 2021, 15 percent of the mitigation site’s

totalrestoration and enhancement creditsshall be available for sale immediately after
the completion of implementation of the mitigation plan and Corpsapproval of the
baseline monitoring report and as-built survey.By copy of this correspondence, we
confirm that you have satisfied the above requirements for the as-built credit release,
and 980.120 stream mitigation units (SMUs) and 0.921 wetland mitigation units (WMUs)
are now available for sale. With this release, 1,960.240SMUs and 2.021 WMUs (30
percent of the total restoration and enhancement credits and 100 percent of the total
preservation credits) have been released for sale.Theattached credit release schedule
has been updatedto reflect the change in total wetland credit proposed to be generated
on the site. Please ensure that future credit release requests utilize the updated credit
release schedule.
