There are several scenarios that might apply:
1. If the County retains ownership of the BMP and a portion of the original parcel covered by the
permit, and the balance of the property is sold, the County will need to convert their existing
070323 permit to a high density subdivision permit, and assign a BUA limit to the portion of the
property being sold. Only the County can modify their permit Mr. Benton would then need to
apply for an offsite permit to utilize the existing BMP.
2. If the County will sell it all to Mr. Benton, then that would be a transfer of ownership. Mr.
Benton could propose his changes after the permit is transferred.
3. If the County will sell the balance of the property to Mr. Benton, and require that he treat his
own stormwater, then that still requires the County to modify their permit to reduce the project
area and the drainage area to the permitted BMP. And, Mr. Benton still would need to get a
separate permit for the development of his property.

Good morning Georgette, I have client Mr. Warren Benton and he is interested in purchasing some property from the
Carteret County ABC board. They built an ABC store and had plans to expand the site for the county abc distribution
network. Those plans have changed and therefore the balance of the property is up for sale.
Mr. Benton would like to get copies of the file including plans and calculations so we can determine what we would
need to do to modify the stormwater permit. Can you forward this to the individual that can help Mr. Benton, he is cc'd
