Mr. Carangelo,
On June 9, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until all of the following information is received:
Please provide a map that delineates the boundaries of the land proposed to be utilized by the applicant in
carrying out the activity; the location, dimensions, and type of any structures erected or to be erected on the
lands for use in connection with the activity; and the location and extent of the receiving waters, including
wetlands within the boundaries of the lands. [15A NCAC 02H .0502(a)(9)]
All work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact with
the disturbed area. Therefore, dewatering methods will be necessary to temporarily dewater the stream
channel during culvert installation. Please provide a construction sequence that details the method of
dewatering to be utilized at the site and the sequence of construction events to be followed to ensure
compliance with this condition. [15A NCAC 02H .0506(b)(3)]
3. Please provide a culvert cross section detail showing the provisions for aquatic life passage/culvert burial that
demonstrates the culvert will meet condition 11.11 of 401 Water Quality General Certification 4256. [15A NCAC
02H .0506(b)(2) and (3)]
4. The Division is in receipt of attachment 4j provided with the Pre -Construction Notification, which is referenced in
section CAL of the PCN. However, the details provided in the attachment do not match the narrative description
of the project. Please explain the discrepancy including culvert length, diameter, whether a rip rap pad is
proposed at the culvert outlet, whether there is an existing culvert that will be replaced, etc. [15A NCAC 02H
.0502(a)(9)]
5. It appears that access to the parcel could be provided by sharing a driveway with an adjacent parcel. Please
explain why access to the property cannot be provided through a shared driveway thereby avoiding the stream
impact. [15A NCAC 02H .0506(b)(1)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by August 11, 2023. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
