Attn: S. Wade Norris 168 Norwood Blanchard Road Wallace, NC 28466 Subject: Compliance Evaluation Inspection NPDES General Stormwater Permit NCG070000 Certificate of Coverage NCG070224 New Hanover County Dear Mr. Norris: On July 20, 2023, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources (DEMLR), conducted a compliance evaluation inspection for Riverside Sand Co., LLC located in 1495 Point Harbor Rd, New Hanover County, North Carolina. The site drains to Cape Fear River, which is currently classified as Class C Waters in the Cape Fear River Basin. The following observations were noted during the DEMLR inspection (please see the attached addendum for additional information about your permit): 1)Stormwater Pollution Prevention Plan (SPPP)was not evaluated during the inspection. 2) Qualitative Monitoring was not evaluated during the inspection. 3)Analytical Monitoring was not evaluated during the inspection. Permit rescission submitted 12/5/2023. Permit rescission is denied. Coverage under NCG070000 is required for: ♦ All owners or operators of stormwater point source discharges associated with activities classified as establishments primarily engaged in activities classified as Stone, Clay, Glass, and Concrete Products [Standard Industrial Classification(SIC) 32]; ♦ Stormwater point source discharges from like industrial activities deemed by The Division of Energy, Mineral, and Land Resources (DEMLR) to be similar to these operations in the process, or the discharges, or the exposure of raw materials, intermediate products,by-products, final products, or waste products. To be able to rescind the permit,you must submit a plan of action to this office to remove potential pollutants from the area.You must in the interim maintain all aspects of the permit requirements including the SPPP and monitoring requirements. Thank you for your assistance and cooperation during this inspection. Please be advised that violations of the NPDES Stormwater General Permit may be subject to a civil penalty assessment of up to$25,000.00 per day for each violation.
