Good Afternoon,
The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete Stormwater Management Permit
Minor Modification Application for the subject project on April 26, 2023. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000 - 1062 rules. We are forwarding modified, updated, and re-issued Permit No. SW3170101, dated July 18, 2023,
for the construction, operation and maintenance of the subject project and the stormwater system. This permit shall be
effective from the date of issuance and shall be subject to the conditions and limitations as specified therein, and does
not supersede any other agency permit that may be required.
The original signed permit package and approved plans are being mailed to the permittee, Father Thomas Kessler, at the

We received your post-construction stormwater Minor Modification permit application for the above mentioned project
on 4/26/2023. Reviews under the standard permitting process can take up to 90 calendar days to complete. You can see
where this project stands in the review queue by emailing me (I have an autoreply set up that has the review queue on
it). Please upload all documents that you mailed into our office through the link provided below. Be sure to choose the
Central Office as the Primary Contact office. Please also upload any files that you have that are associated with the
originally issued permit as we do not have an electronic copy of these files in our repository.

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be
entered into the electronic form by clicking on the “Add Another Post-Construction File Upload” link directly below the
“State Stormwater Information Uploads” section of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads) will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selecting the correct file type ensures that the files are properly named in the electronic repository and it helps
expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan

Per the information provided to the Division on March 29, 2023, the proposed modification appears to meet the
requirements for a minor modification (since there does not appear to be an increase in BUA and there are no proposed
changes to the SCMs. Please provide a minor modification form (https://www.deq.nc.gov/about/divisions/energy-
mineral-and-land-resources/stormwater/stormwater-program/post-construction-program/new-permits-permit-
modifications) or let me know if you would like this to be processed as a major modification. Please also note that the
applicant and signing official that we have on record for this project are St. Philip Catholic Church, and Thomas Kessler
respectively. Please either adjust the applicant information on the application to match our records or complete either a
Permit Information Update Form (same link as above) or a Transfer Application
(https://www.deq.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater-program/post-
construction-program/permit-transfers-renewals) as appropriate.
Per the information provided to the Division on March 29, 2023, the proposed modification to the subject project does
not appear to meet the requirements to be considered low-density. Per 15A NCAC 02H .1003(2)(c), a minimal amount of
non-vegetated conveyances can be used in certain circumstances when it cannot be avoided, however the proposed
piping in the blue hatched area (per the email sent on 3/3/23) appears to be excessive, positive overland drainage
should be able to be provided for this area.
Per satellite imagery of the site (see attached), it appears as though the site was modified in 2021 without prior approval
from the Division (required per Part II, 7 of the permit). This issue is being referred to staff in the Regional Office for
possible enforcement action.
