You cannot require them to treat this previously built BUA, but you are also not obliged to permit this project modification as they already have a permit through the State and are subject to that permit until rescinded. If they would like to have this project permitted locally, they will need to voluntarily treat what was approved by the State in 2017 up to your standards (and then they can apply to have the State permit rescinded). If you could give me a call to discuss it would be very appreciated. The consultant says they do not want to go through the State due to the time for review. If they are to be permitted through the City would we have to require post-construction for what they did in 2017? (Site permitted for low-impact development/permit attached) We do not have low-density development in our ordinance. 1 Their proposal now is to add roughly 4,964 sf of impervious area. Adding impervious should be reviewed through the State to make sure they meet the low-density requirements. If we review, our ordinance says existing impervious prior to date of ordinance adoption cannot be required to have stormwater controls. This would then mean no post- construction from our perspective but then how could they rescind the State Stormwater Permit? It is very convoluted and complicated with no clear direction on how to address it. Thanks for your help with this and I look forward to hearing from you. One follow up question. If we were to permit the project, since there is not a low density option in our ordinance, we would have to require they treat all the new impervious, including what was permitted under the low density option? The files for this project have not yet been digitized so you will need to reach out to staff in the Mooresville Regional Office to get those. They were approved for Low Density through the State in 2017. We have received a concept plan for the property for some new work and I am trying to gather some background information so I can properly respond for their concept plan meeting. The City of Statesville will be the permitting authority now, with our stormwater program in place. We do not have a low density option in our ordinance currently.
