The Orange Water and Sewer Authority (OWASA) is in receipt of the subject Notice of Violation
(NOV) dated June 26, 2023 (received July 3, 2023), concerning a monitoring frequency violation for
Turbidity (00076), Carbonaceous BOD (cBOD) (80082), Fecal Coliform (31616), Ammonia Nitrogen
(00610) and Total Suspended Solids (TSS) (00530) (see Attachment 1).
We performed the required turbidity, cBOD, fecal coliform, ammonia nitrogen and TSS sampling
from February 1, 2023 through February 12, 2023. On February 13, 2023, the reclaimed water
(RCW) system was shut down and no flow was discharged from the Mason Farm Wastewater
Treatment Plant to any RCW user for the remainder of February while a contractor replaced
multiple RCW distribution system pipe couplings as part of a Capital Improvements Program
project. The RCW system resumed operation on March 7, 2023.
In the February 2023 NDMR, we noted the incorrect RCW system shutdown date of February 19,
2023 instead of the correct date of February 13, 2023. Therefore, it appeared as though the
February 2023 NDMR report was missing sample data from February 13tn through February 19tn
Per guidance received from you and a voicemail from Dorothy Robson on July 10, 2023, we revised
and resubmitted our February 2023 NDMR (see Attachment 2) on July 11, 2023. In the revised
report, we stated in each testing parameter column 'No Flow' from February 13' through
February 28'. We also revised the statement on the certification page to make note of the correct
date we stopped sending flow out from the reclaimed water system.
To prevent this clerical error from happening again, we have changed our reporting process to
include 'No Flow' in the individual parameter cells for each day the RCW system is shut down in
the future.

Thank you for your guidance and support working through this process. We respectfully request
NOV-2023-MV-0115 be rescinded in consideration of the information we have provided including
(1) we did not have monitoring frequency violations, rather we had a clerical error and typed the
incorrect date the reclaimed water system was shut down for maintenance on the NDMR; (2) we
submitted the revised NDMR indicating no flow on the dates the system was shut -down as soon as
we were notified of the issue and received guidance on how to correct it; and (3) we have taken
corrective action to prevent reoccurrence on future NDMRs.

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's Non -discharge Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten 10 business days after receipt of this Notice.
review of your response will be considered along with any information provided on the submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.
