received on April 19, 2023. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on August
17, 2023.

rules and regulations. Any oversights that occurred in the review of the subject application package are

1. The Back-up ORC listed in Section V, Austin Mullineaux, is not listed in our system as a backup
ORC for this facility. Please contact the Wastewater Operator Certification about designating a
licensed Back-up ORC for this system with a proper SI certification in accordance with 15A NCAC
02T .0117(a) and the 15A NCAC 08G rules.
2. The freeboard provided in Section VI for the treatment and storage lagoon is five feet, but Condition
IV.12 lists a freeboard of two feet for these structures. Please clarify if the designed freeboard for
this system is more than two feet as listed in the permit.

1993. In accordance with 15A NCAC 02T .0115(a)(2), prior to reissuance of a permit for a
wastewater facility, the Permittee shall enter into and submit an executed Operational Agreement
with the Division. These agreements shall be re -executed each permit cycle. An updated HOA
operational agreement, attached, shall be submitted for this permit cycle.

1. The permit description for this facility includes the individual septic tank effluent pump systems
and the collection system for the facility, and the Permittee does not own all of the land associated
with the collection system. Pursuant to 15A NCAC 02T .0116(c), provide a copy of the easements,
lease agreements or encroachment agreement allowing the Permittee to operate and maintain the
wastewater collection system on property not owned by the Permittee.
