PROJECT SUMMARY: The applicant proposes to replace an existing pier, floating docks, breakwater and install two 7- pile dolphins at an existing 23-slip residential community marina. 9. NARRATIVE DESCRIPTION: The project site is located adjacent to 6806 Towles Road, adjacent to Greenville Sound and the Atlantic Intracoastal Waterway (AIWW), in Wilmington, New Hanover County. The property consists of an approximately 0.1-acre upland parcel and community marina. The upland portion of the property consists primarily of a walkway to access the 23-slip community marina which is stabilized by a bulkhead. The applicant stated that boat slips can only be leased/bought by property owners within the community who are members of the Greenville Sound Garden Yacht Club. Water dependent structures consist of a timber breakwater that encompasses the two floating dock systems which make up the community marina that is stabilized by a bulkhead. State Permit #196-96 was issued 12/16/1996 for the creation of the marina including the bulkhead, pier, floating docks, and breakwater, as well as to establish an excavation footprint to connect the waters of the marina to the AIWW. The timber breakwater currently had two sections of 5' offsets and 10' overlaps as well as 1/2" gaps between the boards, totaling 1" gaps per linear foot of breakwater wall. The breakwater extends approximately 176' waterward of mean high water located at the bulkhead on the western side of the marina. State Permit #196-96 authorized the existing timber breakwater to extend -6' to - 6.5' below MLW which allowed for 0.5' to 0.75' between the bottom of the timber breakwater and the substrate. State Permit #196-96 expired 12/31/1999. Maintenance excavation events were authorized through CAMA General Permits in 2005, 2014, and 2015. Maintenance and repair to the timber breakwater have taken place over time throughout the life of the marina. The property has approximately 300' of shoreline. The existing marina consumes the riparian corridor of Lots 3 and 4 of Greenville Sound Gardens. Part of the application State Permit #196-96 included a letter of intent for those property owners to deed away any riparian rights of Lots 3 and 4, it is unclear at the time of this application if that occurred. The property owners of the aformentioned lots were notified for this application and indicated no objection and provided signed waivers. 10. PROJECT DESCRIPTION: The applicant proposes to replace an existing pier, floating docks, breakwater and install two 7- pile dolphins at an existing 23-slip residential community marina. According to application materials, the proposed fixed pier would replace the existing fixed pier within the same footprint. The fixed pier/walkway replacement would measure approximately 185' in length and 6' in width. It would extend east from the marina bulkhead before angling to the northeast paralleling the floating dock. The proposed fixed pier/walkway would be elevated to continue to exist above the breakwater similar to the existing pier/walkway. (See Sheet S 1.0 and 52.0) The applicant also proposes to replace the existing floating dock system within the marina in the same footprint. The applicant proposes to replace the approximately 164' long by 6' wide floating dock that runs parallel with the western marina bulkhead. Eight (8) 12' long by 3' wide floating finger piers extend east every 20' along the floating dock. The applicant also Field Investigation Report: Greenville Sound Gardens Yacht Club DCM Major Permit Page 12 proposes to replace the existing approximately 123' long by 6' floating dock on the eastern side of the basin which parallels the fixed pier and breakwater. Six (6) 12' long by 3'4" wide finger piers extend west every 20'. The applicant proposes to replace the entire system within the same footprint. The floating docks allow for 23 formalized slips within the marina. (See Sheet S 1.0, S 1.1, and "Marina MapSurvey") Both existing breakwaters are proposed to be replaced. A proposed 0.75' thick vinyl breakwater would replace the existing timber breakwater. This vinyl breakwater would extend approximately 62' east from the south side of the shoreline bulkhead before turning northeast for an additional 10'. At this point there would be a 5' offset and 10' overlap with a wall paralleling the floating dock extending northeast for 108' in length. Another 5' offset and 10' overlap, and the breakwater extends north for approximately 22' and northwest for 33'. A 7.5' portion of breakwater would also be replaced extending south from the northern marina groin. The proposed length dimensions are the same as the existing timber breakwaters (See Sheet S 1.0). According to application materials, the proposed vinyl breakwater would extend approximately -4' to -5' below Mean Low Water (MLW) which would allow for a minimum of 2' from the bottom of the breakwater to the substrate. The breakwater would have 3" wide by 2.8' long slots in each sheet pile flange at every sheet (slots will be place in flanges without a joint). The slots will be located 6" above Mean Low Water and 6" below Mean High Water. (See Sheet 56.0) The applicant proposes two (2) 7-pile dolphins to be placed on the northeast side of the marina in an attempt to alleviate wave action into the marina. The dolphins would be placed where current channel markers for the marina basin exist (See Sheet 50.0, S 1.0 and 57.0) The existing concrete cap on the bulkhead is proposed to be repaired as needed. (See Sheet 1.0) The applicant also asks for a previous permit condition revision which limited the maximum size of boat allowed within the marina to not be a condition associated with this proposal. State Permit #196-96 Condition #2 limited the marina's vessels to 24' or less. Per the applicant's narrative, they request that there be a permit condition of "no permanent heads that have unlocked valves allowing the release of waste into surrounding waters". The applicant states the facility does not have any pump out facilities so the applicant states "waste could not be dumped into the environment as boats would be forced to go to a location where a pump is located since no unlocked valves allowed would prevent someone from dumping without pumping" (See Project Narrative). This area appears to be OPEN to shellfishing. A pump out has not been proposed with this project. No excavation is proposed in this application. The footprint shown on the application drawings is based on the footprint of expired State Permit #196-96 and solely for informational purposes. 11. ANTICIPATED IMPACTS: The proposed community marina renovation structures would incorporate approximately 10,196.25 sq. ft. of Public Trust Area and Estuarine Waters, most of which has been usurped by the existing community marina. Proposed structures do not encroach into the 15' riparian Field Investigation Report: Greenville Sound Gardens Yacht Club DCM Major Permit Page 13 setback requirement to the south but do encroach into the northern 15' riparian setback requirement and the necessary waiver from the northern riparian property owner has been obtained. The proposed structures would extend approximately 176' into the waterbody, in an area that measures approximately 817' across. As proposed, the community marina appears to not exceed the 1/4 width distance nor encroach into the 80' USACE federal channel setback. The proposed structures would continue to accommodate up to 23 vessels at this location within water depths of approximately -3' to -6.5' NLW inside the previously dredged basin within a designated Primary Nursery Area. Signature of Permittee Greenville Sound "Gardens ` _ Permit#169-96 Page 2 of 3 " ADDITIONAL CONDITIONS Marina and Bulkhead Construction 3) Excavation south of the southern edge of the existing boatramp is hereby deleted 4) All excavated materials will be confined landward of the mean high water (MHW) elevation . contour, and any regularly or irregularly flooded vegetated wetlands, within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 5) If a hydraulic dredge is used, the terminal end of the pipeline from the dredge into the diked retention area will be positioned in a manner so as to prevent dike erosion and to allow adequate settlement of suspended solids. 6) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 7) Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and siltation. 8) No vegetated wetlands will be excavated. 9) Excavation will not exceed 4 feet below the elevation of mean low water (MLW) in the basin and 6 feet MLW in the access channel 10) The bulkhead will not be positioned farther waterward than the mean high water elevation contour or the originally permitted bulkhead alignment at any point along its alignment. 11) All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. 12) In order to protect juvenile shrimp and finfish populations, no excavation may take place between April 1 and September 30 without approval of the Division of Coastal Management in consultation with the Division of Marine Fisheries. Wetland Fill 13) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters other than the isolated wetland (6,067 square feet or 0.139 acre in size) which is to be used as one of the dredge disposal sites. r Greenville Sound Gardens Permit #169-96 " Page 3 of 3 ADDITIONAL CONDITIONS 14) The fill material will be cleanand free of any pollutants, except in trace quantities. Metal products, organic materials or unsightly debris will not be used. Marina Operation ` 15) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having the permit transferred to a third party. 16) There will be posted at the manna, and enforced for the life of the project, a no sewage discharge policy. General 17) The project, including the marina capacity, etc., will be strictly in keeping with all local ordinances and regulations. 18) The Division of Water Quality approved this project on November 27, 1996 under Stormwater - Management Permit No. SW8960722. Any violation of this SWMP will be considered a violation of this CAMA permit. NOTE: The Division of Water Quality approved this project on September 4, 1996 under General Water Quality Certification No. 3025. NOTE: The permittee should contact the New Hanover County mosquito control office for advice on mosquito control on the project. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land -disturbing activity. The creation of the residential community marina under State Permit #196-96 included application materials with the intent to deed restrict Lots 3 and 4. It is unclear to this office if that has occurred, so this office recommends a permit condition to deed restrict Lots 3 and 4 of their riparian rights since the existing residential community marina and proposed renovations usurp the lots riparian corridors. This proposal includes the replacement of two breakwaters within an area deemed Primary Nursery Area (PNA) by the NC Division of Marine Fisheries and SA; HWQ by the NC Division of Water Quality. Signature of Permittee ADDITIONAL CONDITIONS Marina and Bulkhead Construction 3) Excavation south of the southern edge of the existing boatramp is hereby deleted. 4) All excavated materials will be confined landward of the mean high water (MHW) elevation contour, and any regularly or irregularly flooded vegetated wetlands, within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 5) If a hydraulic dredge is used, the terminal end of the pipeline from the dredge into the diked retention area will be positioned in a manner so as to prevent dike erosion and to allow adequate settlement of suspended solids. 6) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. ; 7) Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and siltation. 8) No vegetated wetlands will be excavated. 9) Excavation will not exceed 4 feet below the elevation of mean low water (MLW) in the basin and 6 feet MLW in the access channel. 10) The bulkhead will not be positioned farther waterward than the mean high water elevation contour or the originally permitted bulkhead alignment at any point along its alignment. 11) All backfrll materials will be obtained from a highground source and confined landward of the permitted bulkhead. 12) In order to protect juvenile shrimp and finfish populations, no excavation may take place between April I and September 30 without approval of the Division of Coastal Management in consultation with the Division of Marine Fisheries. Wetland Fill 13) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters other than the isolated wetland (6,067 square feet or 0.139 acre in size) which is to be used as one of the dredge disposal sites.
