The site is located along 2.4 miles of the oceanfront beach in waters of/adjacent to the Atlantic Ocean, between 3690 Island Drive to the north end of Oceanview Lane in the Town of North Topsail Beach, Onslow County, North Carolina. Approximate Coordinates in Decimal Degrees are (start): 34.473989 N,-77.458449 W; (end): 34. 490787 N,-77.422311 W. The applicant proposes to conduct additional beach nourishment via truck haul from the ST Wooten and 421 Sand mines. Specifically, the proposed project would consist of a maximum placement volume of 353,021 cubic yards of compatible fill along—12,585 linear feet of shoreline. Specifically, the applicant proposes to modify the previous authorization by extending the truck haul project through Phase 5 and into Phase 4. The proposed project would result in the filling of approximately 19.6 acres above mean high water, with a fill volume of up to 109,804 cubic yards. An additional 46.7 acres of fill would occur below mean high water (213,217 cubic yards). Temporary increases in turbidity can be expected during construction, but should be minimal given the method of construction and dry sand to be used. Temporary impacts to the frontal dune are also expected to be minimal given the previous dune work already performed and use of the existing beach access. The applicant proposes to limit work between November 16 through April 30, thereby avoiding peak periods of biological activity. Please see the attached field investigation report, modification request, project history, and plans for detailed information concerning the proposed project. *I have also included the previous Corps authorization for the Phase 5 Mod project dated January 18, 2022 and your agency's prior response (emails from USEPA, USFWS, Corps 408 Coordinator and Navigation). Phase 5 construction is nearing completion and the applicant is planning to continue work into Phase 4 as soon as possible to meet the environmental window. EFH, ESA and 106 determinations remain unchanged. EFH: This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The waters within the project area are NOT designated as PNA by the NC Division of Marine Fisheries, are classified as SA/SB waters by the NC Division of Water Resources, and are OPEN to harvesting shell fish. ESA: The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps believes that this proposed projects would remain covered by the North Carolina Coastal Beach Sand Placement Statewide Programmatic BO, dated August 28, 2017. The Corps will require the project to comply with terms and conditions of the SPBO. Additionally, the project remains covered by the 2020 South Atlantic regional BO (SARBO). NHPA 106: Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and records and the latest published version of the National Register of Historic Places and initially determines that no historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area: therefore, there will be no historic properties affected.
