To be honest, I’m not sure. I’ve outlined what would need to be done for each scenario. If the future BUA allocated to
SW6201005 is enough to cover the Phase II improvements that will be added to the SW6201005 project area then that
might be the easiest option. Covering Phase II under a major modification to SW6201005 does simplify things since there
will only be the one permit to deal with.
If you are going to do handle Phase II as a Major Modification to SW6201005 you will need to make the following
changes to the submittal materials:
- Application:
o Section II, 1, a – Indicate that this is a modification
o Section II, 1, b – Add the original permit number (SW6201005) and issue date (2/8/2022)
o Section IV, 4-7 – These items would be revised to include the entire project area (Phases I & II). For
clarity, you may wish to include the Phase I, Phase II, and total areas for each item.
o Section IV, 8 – This item would be recalculated based on the total amount of BUA added to the site and
the total site area.
o Section IV, 10 – This item would be revised to include the entire project area (Phases I & II). For clarity,
you may wish to include a Phase I, Phase II, and total site column.
- Supplement-EZ Form – Similar to the Application, the project area and drainage area information would need to
be revised to include the entire site (Phases I & II).
- Provide a hard copy of the required recorded documents (if the individual lots have not yet been sold off, you do
not need to provide these items at this time, please refer to Item 7 of the 2/8/22 permit).
- Provide As-built Certifications (forms included as part of the issued permit and also available at
https://deq.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater-program/post-
construction-program/post-construction-forms) *only if construction on Phase I has begun.
NOTE: If you are doing this don’t forget that permit SW6201005 has 66,484 sf of future BUA allocated that can
be used and if the deed restrictions for Phase I have not yet been recorded, you can redistribute the per lot BUA
allocation (if you want to).
If you are going to do handle Phase II as a separate project and modify SW6201005 you will need to do the following:
- Option 1 – Leave the Phase I project area alone. The permit for Phase I has 66,484 sf of future BUA allocated to
it. If this is enough BUA to cover the BUA that will be added to the SW6201005 project area as part of the Phase
II improvements, you can submit a minor modification for SW6201005 (and show that the BUA being added to
the SW6201005 area is less than the allocated amount of future BUA) and change the provided submittal
materials for Phase II to exclude the SW6201005 area. NOTE: This option may not be 100% practical if the
proposed lots will partly be located in the SW6201005 area and partly located in the new project area.
- Option 2 – Change the Phase I project area. You can reduce the project area of SW6201005 so that it matches
the Phase I area and does not include any Phase II areas via a minor modification. The amount of future BUA
allocated to SW6201005 would need to be reduced so that the maximum 24% BUA for that permit is not
exceeded. You will need to provide revised SW6201005 submittal materials (as part of the minor mod) showing
the new extents of the SW6201005 permit area, revised project area/density calculations, and calculations
showing the new amount of future BUA for SW6201005.

In your opinion, are we better to do a major modification to the existing permit or modify the existing permit by
reducing the project area and continue moving forward with the permit for Ph II?

Good Afternoon,
We received your application for a new post-construction stormwater permit on 7/19/2022. At this time, the submission
is not administratively complete and cannot be accepted for review in its current condition. Please provide the following
submittal items within 30 calendar days (by close of business on 8/19/2022) so that we may accept the project and
begin the review process, otherwise, the project will be returned as administratively incomplete.
The two pieces of property (see attached) and the piece of property that the Wood Lake II Phase I development
is located on are already covered under permit SW6201005 and cannot also be included under this new permit.
Please either exclude these areas from this new permit (and modify permit SW6201005 to account for the
proposed improvements to that area) or permit this as a major modification to permit SW6201005.
2x signed & sealed hard copies of a plan sheet showing the following:
Drainage areas to the vegetated conveyances. This item is required per Section VI, 8o of the Application
and 15A NCAC 02H .1042(2)(g)(iv).
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brough up during the engineering review
NOTE: Please do not send submittal materials to the Regional Offices, doing so delays the review process.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process can take up to 90 calendar days per statute (one of our
two reviewer positions is currently vacant).
