We finally got the DOT's decision on the project's access drive issue. The DOT has requested the access drive
be moved to the western side of the project, for which the applicant is preparing the plans.
While they are in the process of securing the necessary permits for that permanent crossing, they would like to
continue with the current application, which will now be for temporary access, until the permits have been
issued.
That being said, I would like to take the project off hold with the agencies. Do I need to send in revised plans
and PCN to reflect the change from permanent to temporary?

It has come to my attention that the DWR must have written documentation that the Corps has approved the
requested extension, and the approval must come from Mickey. Will you please make sure the request has
been forwarded to him, so we don't run into the same issue I had today, where we hit the 1201h day, and the
DWR was going to deny the permit or I would have to withdraw the application, from the DWR, and resubmit
the PCN, with another filing fee.

application, until July 15, 2023. The Applicant is currently working with the DOT to finalize the access road off
Hwy 211. However, they are uncertain as to how long this issue may take and, therefore, the final development
plans, which may include changes to wetland impacts, have not been submitted to the DWR for their review
and processing.

Per 40 CFR 121.6, the applicant can request that the USACE extend the federal clock for DWR action on the 401
application. The request will need to be sent to the USACE outlining why additional time for DWR to complete the
review is necessary, i.e. the impacts to wetlands have changed, have not been presented to DWR for review and the

2/14/20. I see Robb was copied on the ATF NWP 18 that was issued on 1/28/2020 and prior to the NWP 14

Hope you are doing well. The client is working with the county and the DOT on the driveway alignment and
haven't got final say on the proposed layout. However, I see we are getting close to our 60 day threshold, so I
think we need to put this project on hold.
On another note, I was looking for the 401 WQC that would have accompanied the previously NWP 14, but we
have not been able to get a copy of it. Considering the version number of the project is 1, 1 expect that it was
never issued, but I think there should have been. Can you look into that for me?
