Joe,
I was looking over the additional information you provided on 3/28/23. Everything looks good except for a few small
issues:
Please correct the following:
- As designed, the project will not meet the definition of low-density per 15A NCAC 02H .1003(2)(b). The proposed
design does not maximize dispersed flow through vegetated areas/minimize the channelization of flow. There is
a difference between designing a project to maximize dispersed flow through vegetated areas and designing a
project and then maximizing dispersed flow through vegetated areas. As currently designed, the length of pipe
STP-206 appears to be able to be reduced. The length of pipe STP-206 could be reduced by including a vegetated
conveyance between lots 86 & 87 that would direct runoff from the low point at the back of these lots to a point
closer to the street. NOTE: Adequate space was provided between lots 85 & 86 to accommodate the sanitary
sewer easement so it is not unreasonable to also provide adequate space between lots 86 & 87 to
accommodate the vegetated conveyances required per 15A NCAC 02H .1003(2)(b).
- Per 15A NCAC 02H .1003(4)(e), stormwater runoff that has not been treated in an SCM shall not be discharged
through a vegetated setback. The proposed culvert under Spirit Drive from HW-1 to HW-2 is shown to have two
catch basins, CB-123 & CB-126 that collect untreated stormwater runoff from the proposed roadway and
sidewalk and discharge it to the surface water (being conveyed through the culvert) without allowing it to flow
through the vegetated setback as dispersed flow. Please revise the design so that this requirement will be met in
the final design

We received your post-construction stormwater Authorization to Construct (ATC) permit application for the above
mentioned project on 3/28/2023. Reviews under the Fast-Track permitting process can take up to 30 calendar days to
complete. You can see where this project stands in the review queue by emailing me (I have an autoreply set up that has
the review queue on it). Please upload all documents that you mailed into our office through the link provided
below. Be sure to choose the Central Office as the Primary Contact office.

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be
entered into the electronic form by clicking on the “Add Another Post-Construction File Upload” link directly below the
“State Stormwater Information Uploads” section of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads) will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selecting the correct file type ensures that the files are properly named in the electronic repository and it helps
expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan
sheets (such as lighting plans, utility plans, striping plans, sight distance plans, etc…) as these files are not needed for

We received additional information for the subject project on 3/28/2023. The following items are still missing from the
submission:
Prior Comment – 2x hard copies of official documentation showing the title and position of the signing official
for the Applicant and showing that the Applicant organization is in good standing with the Secretary of State.
These items are required per Part F7 of the Application and 15A NCAC 02H .1043(3)(b). This item was not
provided in the resubmission. The signing official, Mr. Derrickson, is not listed on the provided document
showing the tile and position information. The signing official must be at least the rank of Vice President or
higher (per 15A NCAC 02H .1040(1)(a)) or must be an authorized representative of someone of rank Vice
President or higher (you could, for example, provide a letter signed by someone VP or higher stating that Mr.
Derrickson is authorized to sign this permit or change the signing official in the Application to someone VP or
higher).
Please provide these items by close of business on 4/6/2023 so that we may accept the project and begin the review
process, otherwise, the project will be returned as administratively incomplete.

required per 15A NCAC 02H .1043(3)(a)):
Part E5 – The project density does not appear to be calculated correctly. For a project with existing BUA,
the % BUA is calculated as \[New BUA\] / (\[Total Project Area\] – \[Existing BUA\]). Per the information in the
table, \[New BUA\] = 611,454 sf, \[Total Project Area\] = 2,577,537 sf, & \[Existing BUA\] = 6,243 sf. This
results in a percent BUA of 23.78% (611,454 sf / (2,577,537 sf – 6,243 sf) = 23.78% while 23.96% is
shown). Please revise as needed.
2x hard copies of a construction sequence discussing how any future development on the project may be
phased. This item is required per 15A NCAC 02H .1043(3)(g). The construction sequence does not need to be
lengthy, just a brief description of how future development on the project (beyond what is shown on the
plans) will be phased. If no future development is planned for the project, you can simply state that in the
construction sequence. This item is different than the E&SC sequence of construction. This item was not
provided in the resubmission.

Good Morning,
We received your application for a new Fast-Track ATC post-construction stormwater permit on 3/3/2023. At this time,
the submission is not administratively complete and cannot be accepted for review in its current condition. Please
provide the following submittal items within 30 calendar days (by close of business on 4/6/2023) so that we may accept
the project and begin the review process, otherwise, the project will be returned as administratively incomplete.
2x hard copies of the Application Form (or pages) with the following corrections made (A complete application is
required per 15A NCAC 02H .1043(3)(a)):
Part D2 – Please complete this information.
Part E4 – The stream index and classification number do not appear to be correct. This information can
be found at the following address:

of the maximum allowable %BUA for a low-density project. Please revise as needed.
1x original signed and notarized/sealed hard copy of Parts G & H of the Application. 2x original signed hard
copies of this form are required and only one was provided (the other copy appears to be a photocopy).
2x hard copies of a construction sequence discussing how any future development on the project may be

NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brought up during the engineering review. The following items were noted during the review, but do not need
to be addressed for administrative completeness:
- Untreated stormwater runoff cannot be directly discharged to a surface water (as appears to be the case with
the culvert near Lots 1 & 111) it must be released at the edge of the vegetated setback and allowed to flow
through the vegetated setback as dispersed flow (per 15A NCAC 02H .1003(4)(e)).
- There appears to be excessive piping for this project to be considered as low-density (notably the pipes located
between lots 14 & 15, 19 & 20, and 86 & 87). Per 15A NCAC 02H .1003(2)(c), vegetated conveyances should be
used in these locations.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the Fast-Track permitting process can take up to 30 calendar days per statute (one of our
two reviewer positions is currently vacant).
