Hi Rick. The Corps is amenable to this proposal without requiring additional compensatory mitigation
in the case as the additional wetland impacts appear to be overlapping at least somewhat with
stream channel impacts. Send on the revised PCN/plans. Thanks.

We will be revising the PCN to account for the 0.0008 ac (33 SF) of additional permanent wetland
impacts in item (2) of your email received on 7/1/23. Previously, 0.132 acres of wetland mitigation
was purchased, and we feel that the additional 0.0008 acres of permanent wetland impacts is
inconsequential, and we don't feel additional wetland mitigation is necessary. If you and Seren can
let me know if you all agree I can move forward with sending a revised PCN.

Thank you for your PCN, dated 5/26/2023 (received 6/2/2023), for the above referenced project. I
have reviewed the information and need clarification before proceeding with verifying the after -the -
fact use of Nationwide Permit (NWP) 39 (https://saw-reg.usace.army.mil/NWP2021/NWP39.pdf).
Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this
Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider
your application withdrawn and close the file:
1. The PCN is not signed (Section 1) and therefore is not considered complete.
2. It appears that the additional length of culvert on the upstream side of the crossing has been
extended through a section of stream with immediately abutting wetlands, although no
additional permanent wetland impacts have been proposed. Please explain this apparent
discrepancy or update the PCN (including the compensatory mitigation plan) and plan sheet
accordingly.
3. It appears that an Individual 401 Water Quality Certification (WQC) is required from the North
Carolina Division of Water Resources (NCDWR) for this project. Per the 2020 CWA Section 401
Rule, the PCN must contain the 9 elements listed in Section 121.5(b) of the Rule. According to
the 9/16/2022, Programmatic Agreement (PA) between the USACE, Wilmington District, and
the NCDWR, the Reasonable Period of Time (RPOT) for NCDWR to act on a Section 401
certification request is 120 days after receipt of a certification request containing the 9
required elements. However, it appears that items 8 and 9 (see item 1 above) of the 9
elements are not met; as such, NCDWR's RPOT has not started yet. Please note that the Corps
cannot verify the use of any NWP without a valid 401 WQC.
