We do not have a record of the permit being transferred to the new permittee. To transfer the permit from the current
permittee “Utah Development, LLC” to the new permittee, “NC Salisbury, LLC”, you need to complete the ATC
Application Form (indicating a transfer in Section C.1. of the form, updating the contact information, resigning & sealing
the forms, paying the application fee, providing designer certification forms for any SCMs that have been completed,
and updating any of the previously submitted items required in Part F (like Secretary of State/signing official
information).

Since this was completed, we transferred the property internally from Utah Development, LLC to NC Salisbury, LLC and I
can’t remember if I transferred the permit with you all. If not, how would I do that?

Good Afternoon,
The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete, Stormwater Management Permit
Authorization to Construct (ATC) Application for the subject project on February 28, 2023. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000 - 1062 rules. We are forwarding ATC Permit No. SWA000189, dated March 29, 2023, for the
construction of the subject project and the stormwater system. This permit shall be effective from the date of issuance
and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency
permits that may be required.
The original signed permit package and plans are being mailed to the permittee, Christopher Davis, at the following

Reminder: Please be aware that per 15A NCAC 02H .1044(2), the Erosion & Sediment Control (E&SC) permit for this site
cannot be closed out until the as-built stormwater plans for this project are approved by our office.
