The following is a recap of conversations we have had as I have not gotten a response from DEQ from my last emails and phone calls:

On behalf of my clients, Epcon Communities, Wetland and Environmental Solutions (WES) applied for a joint permit application for a residential subdivision through the portal on January
2nd, 2023. The application was sent to the Corps and DEQ at that time, indicating the surveyed wetland and stream boundaries that were delineated within the project footprint. The boundaries
were approved in the field by the Corps of Engineers prior to permit application in a field preapp. No questions were received by the Corps regarding the application during the Corps'
review, even with prompting, which indicates that the Corps had no questions regarding the WOTUS boundaries, including two historic pond areas (W4 and W5) that have functioned as wetlands
and were delineated as such. These two wetlands are proposed to be graded out during construction. The historic pond areas have been encumbered with a riparian buffer although they
are functioning as wetlands rather than surface waters. The buffer call predates this permit application.

Below are Zack's questions and WES responses are red.

The current application submitted is missing the buffer determination information and correspondence from the USACE stating that the historic ponds are no longer considered open waters,
but rather wetlands and is therefore not accurate or complete.

The Corps agreed with the wetland boundaries during field review and effectively approved the surveyed features on the plans by not asking any questions. It is proposed that DEQ document
this in the file and proceed with evaluation of the project as presented in the plans. As indicated in the email chain included here, the Corps has not addressed requests for comment
from either the applicant or the DEQ, indicating that the project meets the requirements for the Nationwide.

Our email conversations regarding the ponds/buffers from 2/23/23 performed under DWR# 20-129 <https://edocs.deq.nc.gov/WaterResources/DocView.aspx?id=1209807&dbid=0&repo=WaterResources>
are not reflected in the current design maps. Please provide documentation from the USACE about the pond features or the impact maps need to be updated to reflect the 50-foot buffer
zones around the mapped pond features located at the top of stream features S2 & S3.

The old buffer call is not applicable to W4 and W5 at this point since 1) the features are wetlands which are specifically not protected by riparian buffers by rule and 2) the features
are going to be graded out: the riparian buffer is specifically intended to address potential water quality impacts to a protected feature: if the feature is proposed for impact then
the buffer call becomes irrelevant as it applies to that particular feature. The Corps has effectively approved the survey of WOTUS features included with the application as discussed
above.

The PCN also is requesting impacts to the W4 wetland (potential pond), do all other buffer items shown on the impact maps fall under “deemed” in the table of uses?

All the buffer impacts for the project fall under "deemed" based on the table of uses in 15a ncac 02b.0714.

My client has worked diligently in designing this project to prioritize stream buffers and to reduce environmental impacts to the greatest extent practicable. Buffers on the streams
exceed the requirements project-wide and we have done our part in working with the agencies on this permit application. Please proceed with issuance of the water quality certification
with no further delay.
