2f. Comments:
The variance was previously approved in 2019 and the mitigation has been paid, see attached mitigation transfer
certificate. The project is exactly the same as previously approved, but the work could not be completed due to delays
associated with COVID shutdowns.
G. Stormwater
1. Provide a description of how diffuse flow will be maintained through the protected riparian buffers (e.g., re -planting
vegetation or enhancement of existing vegetation, gutter splash pads, level spreader to control of runoff from
impervious surfaces, etc.). *
Danny Smith and Stephanie Goss previously evaluated the site and determined the limits of existing uses
(specifically parking, buildings and driveways) that are exempt from the buffer rules and can continue to be used for
their existing use so no stormwater plans are provided for those areas. However the new impervious area will be
treated by a bioretention cell (see attached impact maps for location) which will discharge to an existing stormwater
collection system. Calculations for the bioretention cell are attached.
A significant portion of the new sanctuary will be constructed where existing buildings or other imperviuos surfaces
exist.

H. Demonstration of Need for a Variance
The variance provision of the riparian buffer rules allows the Division or the Environmental Management Commission to grant a variance when there are practical difficulties or
unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection.
1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable
return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit
from the property shall not be considered adequate justification for a variance. The Division will consider whether the
variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable
use of the property possible.*
The sanctuary expansion is need to accommodate the increasing congregation size. The existing sanctuary will
remain in use during construction of the new sanctuary then it will be demolished and the new parking lot will go
where the old sanctuary was Iocated.They are not even meeting minimum parking requirements for town
requirements but are applying for a special use permit for less parking and having shared parking with the church
across the street. If not for this even more buffer impact would be required
2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such
as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc). *
The small areas requested to be impacted are actually separated from the undisturbed stream buffer by areas of
driveways and parking. Therefore the function of these areas as far as nutrient removal are limited. In addition the
areas are currently maintained as a lawn.
3. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer
Rule. *
The site is not currently in violation of the buffer rule
4. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which
is different form that of neighboring property.*
As described above, this is a developed site in downtown Clayton, much of the buffer contains buildings, parking or
driveways built long before the rules were adopted. Because of the need to expand the church and the limited area
available to do so in proximity to existing church buildings, the proposed expansion is the minimum size that will meet
the current and projected needs of the church. The building has been designed to minimize impact size and located
so that the least functional area of the zone 2 buffer is impacted. In addition, stormwater from new impervious is
being treated by a bioretention cell. Were it not for the variance the Town of Clayton would only require stormwater
quantity , not quality, control.
5. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are
widespread. *
The segment of stream that is exposed is unique in that upstream of the property the stream is piped in its entirety
and down stream it is piped for at least 1200'.
For Neuse, Tar -Pamlico, Jordan Lake and Goose Creek only:

You have elected to fulfill your permitted riparian buffer mitigation requirements for the above
mentioned project by paying into the Old Savannah Nutrient Offset & Buffer Bank sponsored by
Wildlands Holdings II, LLC, wholly owned by Wildlands Engineering, Inc. ("The Bank").
The applicant has received an authorization certificate for riparian buffer impacts and is required to
mitigate as part of the Consolidated Mitigation Rules 15A NCAC 02B .0295. Payment into a private
mitigation bank is acceptable per this rule. NCDWR specified and verified the amount of the riparian
buffer offset necessary for approval of the permit as 1,563 sq. ft. of Buffer Mitigation credits.
Wildlands Holdings II, LLC has receipt of a copy of the 401 Water Quality Certification Authorization
Certificate (Minor Variance Approval) from the NC Department of Environmental Quality approving the
Riparian Buffer mitigation purchase from the Bank. The Bank has received full payment for mitigation
for the above referenced project.
You must also comply with any other state, federal or local government permits or authorization
associated with this activity including SL 2009-337, and Act to Promote Compensatory Mitigation Banks.
This payment into the Bank is not transferable.
