Thank you for allowing the Eagle Creek WWTP the opportunity to respond to the following Notice of
Violation issued March 7, 2023; received on March 10, 2023. Below is our response to the Unauthorized
Bypass that occurred during the February 2023 monitoring period.
The 750-gallon overflow event that occurred on February 19, 2023, was the result of an accident when
operations staff mistakenly dumped material too close to the High -Infiltration Basin. This caused it to
enter the basin and create an overflow of around 750 gallons. The overflow began at 5:00 pm and stopped
at approximately 5:30 PM. DWR as well as the Eagle Creek HOA were both notified the following day,
February 20, 2023, within 24 hours of the incident. The spill was not determined to have reached surface
waters, and as soon the incident occurred, operations staff responded to take the necessary measures to
contain the overflow. The system was otherwise operating within compliance at the moment of the
incident.
In order to prevent future incidents, the personnel responsible has received refresher training on the
operation of the facility and proper equipment usage procedures.
