Andrew, The applicant would like to request a modified 401 Water Quality Certification (WQC) due to the lack of available private bank riparian wetland credits now that mitigation payment is ready for submittal. The issued 401 WQC was issued with a partial use of private bank wetland credits and NC DMS ILF credits. NC DMS ILF is now requested to be used as the sole wetland mitigation provider. I attached the updated list of approved mitigation banks from the NC DMS website (dated June 27, 2023, but was version June 13, 2023, when the NC DMS ILF invoice request was made). I reached out to RES about their Shiitake Ridge site that showed wetland credits available in French Broad 05, and their June 20, 2023, email response (attached) was that they didn't have credits available at that time. By the time I made the June 23, 2023, invoice request to NC DMS (email attached) RES had not informed me of an update to wetland credit availability in the project's watershed. Also attached is a more recent USACE Ribits report of mitigation banks with available riparian wetland credits — again, RES Shiitake Ridge is the only private bank on the list. The applicant respectfully requests that Kelly Williams (Kelly.williams@ncdenr.gov) be copied on the modified 401 WQC for her records pertaining to the INC DMS ILF Invoice that was generated on June 28, 2023 (attached) and sent to the Applicant.
