Dear Mr. Stoltzfus and Mr. & Mrs. Keppler:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on November 11, 2021. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. Please provide sizing calculations for the riprap dissipators demonstrating that the inlets
and outlet of the proposed sand filter is stable in accordance with General MDC 4. It is
noted that the riprap sizing has been provided on plan sheet C3,but it does not appear as
though the sizing calculations have been provided.
2. Since the Applicant is also the Property Owner, Section IX of the Application(the
property owner certification) does not need to be signed. With your permission, I can
cross out the provided signature on the original hard copy that I have. If this is not
acceptable, please provide a revised original Application with only Section X signed.
3. Please ensure that all of the submission items from the initial hard copy submission (such
as the Application,plan set, O&M Agreement Form, property deed, calculations, soil
borings, etc...) are electronically submitted. It appears as though only the items that were
requested on 10/25/2021 were electronically provided.

4. It is recommended to bypass any off-site portions of the area draining to the proposed
SCM around the SCM. Any off-site portions of the drainage area that are not bypassed
must be accounted for at their full built-out potential(per 15A NCAC 02H .1003(3)(b))
which is typically assumed to be 100%BUA. It is noted that the proposed sand filter is
oversized to the point that it currently has the additional capacity that would be required
if the entire off-site portion of the drainage area were assumed to be 100% BUA. If you
do not plan on, or are unable to, bypass this off-site area, please make a note in the
Supplement-EZ Form stating that the sand filter is oversized to account for the off-site
area being developed to its full build-out potential(100%BUA). However, it is still
recommended to bypass this off-site drainage area since the Applicant does not own this
area (and therefore has no control over what future development happens in this area). It
is possible (but unlikely) that the adjoining property owner could develop their property
in a manner that directs more stormwater runoff into the sand filter than it was originally
designed to handle and make the sand filter non-complaint despite the Applicant not
doing anything to cause this non-compliance (bypassing this off-site area would prevent
this from happening).
5. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.

Please reach out to me prior to hand delivering a submission to make
sure that I (or someone else in my group)will be able to receive the
submission. Do not leave the package in the foyer with the
security guard. We do not always get alerted that something has
been dropped off for us, and more often than not, it just sits there
until someone notices that it is missing.
NOTE: Hard copies should not be sent to a Regional Office. Doing so
will delay the review process and the submission package may be lost
while being sent from the Regional Office to me in the Central Office.
NOTE: We have recently been experiencing issues with not receiving
some package deliveries. Please ensure that the delivery address is written
as shown. You may wish to add a tracking number to your submission as
this helps us find wayward packages.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to February 4, 2022, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW4211102 on all correspondence.
If you need additional time to submit the information,please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
