I am going over this project and still am seeing some inconsistencies between the Drainage Area table of the application and the Drainage Area Tables in the Supplement. Also. it appears that in calculating the drnwdown time that the provided volume was used instead of the minimum design volume calculated by the Simple Method. Per NCDEQ, the proposed site is considered a high -density development. As such, the subject site has been designed to include a wet pond located at the rear of the site. The pond has been designed to treat the calculated water quality volume as well as mitigate the 1-year storm event. Calculations associated with the proposed pond are provided in this report. Additionally, the proposed improvements inside of the HWY 117 public right-of-way do not drain to the proposed stormwater control measure (SCM). The proposed drainage pattern is consistent with the existing drainage pattern. HWY 117 is a super -elevated roadway that slopes away from our project site. The proposed driveways connections have been designed to comply with NCDOT slope requirements. In our evaluation of the site conditions, it is our determination that draining the impervious area associated with the improvements inside of the public right-of-way to the proposed SCM is not feasible and would be inconsistent with existing drainage patterns. Furthermore, the proposed improvements inside of the public right-of-way are replacements to the existing driveway improvements already located inside of the right-of-way. In our review of the existing conditions as compared to the proposed conditions, it is our determination that the proposed improvements will actually result in a net decrease of approximately 530 sf of impervious area located inside of the public right-of-way. The area inside of the public right-of-way drains to an existing drainage feature located along the north property line via an existing roadside swale. 4909 Liles Road ENGNEERING Section 2: Existing Site Conditions ENGINEERING Pender County ABC Retail & Warehouse Stormwater Report Grounded Engineering Project #20146 June 13, 2023 Existing Site Conditions Description: The proposed project is located on a single parcel at 0 HWY 117 in Burgaw, North Carolina. The parcel is located at the northeast corner of the intersection of HWY 117 and E. Fremont Street. The existing lot is currently partially developed and includes two (2) site access driveways, paved parking surfaces and multiple structures. Additionally, in review of aerial imagery, it has been determined that the subject site previously had additional structures and parking improvements. In review of the provided survey and the aforementioned aerial imagery, the existing impervious area has been calculated to account for 27,743 sf of the subject site. The site primarily drains north and east. HWY 117 is a super -elevated roadway that slopes away from our project site. In our evaluation of the site conditions, it is our determination that the area located inside of the public right-of-way along the property frontage drains to an existing drainage feature located along the north property line via an existing roadside swale. In addition to the building, the proposed site improvements include parking, sidewalks and supporting infrastructure. The subject site has been designed to include a wet pond located at the rear of the site. A storm drainage system has been designed to collect and carry stormwater runoff from the site to the proposed wet pond. Calculations associated with the proposed pond are provided in this report. The developer is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the developer must take those additional steps necessary to stop sediment from leaving this site (NCGS 113A-57(3)). Each sediment storage device must be inspected after each storm event (NCGS I I3A-54. I(e)). MaintenAnce and/or clean out is necessary anytime the device is at 50% capacity. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regarded with side slopes of 2 horizontal to 1 vertical or less steep (15A NCAC 04B .0124 (d)). Bank slopes may be mowed but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches (NCGS 113A52(6)). 4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include our agency's Stormwater regulations and the Division of Water Resources' enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army Corps of Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal Management's CAMA requirements, the Division of Solid Waste Management's landfill regulations, the Environmental Protection Agency and/or The U.S. Army Corps of Engineers jurisdiction of the Clean Water Act, local County or Municipalities' ordinances, or others that may be required. This approval cannot supersede any other permit or approval; however, in the case of a Cease - and -Desist Omer from the Corps of Engineers, that Order would only apply to wetland areas. All highlands would still have to be in compliance with the N.C. Sedimentation Pollution Control Act. 5. If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the developer is responsible for compliance with the requirements of the Division of Water Resources (DWR), the Corps of Engineers and the Environmental Protection Agency (EPA) respectively. Any erosion control measures that fall within jurisdictional wetland areas must be approved by the aforementioned agencies prior to installation. The Land Quality Section must be notified of a relocation of the measures in question to the transition point between the wetlands and the uplands to assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any requirements of either DWR, the Corps, or the EPA, it is the responsibility of the developer to inform the Land Quality Section regional office so that an adequate contingency plan can be made to assure sufficient erosion control remains on site. Failure to do so will be considered a violation of this approval (NCGS I I 3A-54.1 (b)). 6. Any borrow material brought onto this site must be from a legally operated mine or other approved source. Any soil waste that leaves this site can be transported to a permitted mine or separately permitted construction sites without additional permits under NCGS 74-49(7xd). This permit allows for a land disturbance, as called for on the application plan, not to exceed 2_8 acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and additional application fee. Any addition in impervious surface, over that already noted on the approved plan, would also require a revised plan to verify the appropriateness of the erosion control measures and stormwater retention measures (NCGS I I 3A-54.1 (b)). 8. The construction detail for the proposed silt fence requires reinforcing wire and steel posts a maximum of eight (8) feet apart. Omission of the reinforcing wire is a construction change that necessitates more posts for support, i.e., the spacing distance needs to be reduced to no greater than six (6) feet apart (E&SC Planning & Design Manual 6.63, Rev. 6/06). 9. Because the sediment traps and basins are shown on the plan as the primary sedimentation and erosion control devices on this project, it is necessary that the traps and basins and their collection systems be installed before any other grading takes place on site, and that every structure that receives more than one acre of drainage is built so that each dewaters only from the surface (NCGO 10000). If that proves to be impractical, a revised plan must be submitted and approved that addresses erosion and sediment control needs during the interim period until the traps and basins are fully functioning (I 13A-54. I (b)). 10. A graveled construction entrance must be located at each point of access and egress available to construction vehicles during the grading and construction phases of this project. Access and egress from the project site at a point without a graveled entrance will be considered a violation of this approval. Routine maintenance of the entrances is critical (113A-54. I (b)). 11. This plan approval shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. 2. The developer is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the developer must take those additional steps necessary to stop sediment from leaving this site (NCGS 113A-57(3)). Each sediment storage device must be inspected after each storm event (NCGS 113A-54.I(e)). Maintenance and/or clean out is necessary anytime the device is at 50% capacity. All sediment storage measures will remain on site and functional until all grading and final landscaping of the project is complete (15A NCAC 04B .0113). 3. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regarded with side slopes of 2 horizontal to 1 vertical or less steep (15A NCAC 04B .0124 (d)). Bank slopes may be mowed but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches (NCGS 113A52(6)). 4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include our agency's Stormwater regulations and the Division of Water Resources' enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army Corps of Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal Management's CAMA requirements, the Division of Solid Waste Management's landfill regulations, the Environmental Protection Agency and/or The U.S. Army Corps of Engineers jurisdiction of the Clean Water Act, local County or Municipalities' ordinances, or others that may be required. This approval cannot supersede any other permit or approval; however, in the case of a Cease - and -Desist Order from the Corps of Engineers, that Order would only apply to wetland areas. All highlands would still have to be in compliance with the N.C. Sedimentation Pollution Control Act. 5. If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the developer is responsible for compliance with the requirements of the Division of Water Resources (DWR), the Corps of Engineers and the Environmental Protection Agency (EPA) respectively. Any erosion control measures that fall within jurisdictional wetland areas must be approved by the aforementioned agencies prior to installation. The Land Quality Section must be notified of a relocation of the measures in question to the transition point between the wetlands and the uplands to assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any requirements of either DWR, the Corps, or the EPA, it is the responsibility of the developer to inform the Land Quality Section regional office so that an adequate contingency plan can be made to assure sufficient erosion control remains on site. Any soil waste that leaves this site can be transported to a permitted mine or separately permitted construction sites without additional permits under NCGS 74-49(7Xd). Disposal at any other location would have to be included as a permit revision for this approval. 7. This permit allows for a land disturbance, as called for on the application plan, not to exceed 3.2 acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and additional application fee. Any addition in impervious surface, over that already noted on the approved plan, would also require a revised plan to verify the appropriateness of the erosion control measures and stormwater retention measures (NCGS 113A-54.I(b)). , 8. The plan includes a very specific phasing schedule. If it proves impractical to follow the proposed phasing schedule, a revised plan will be required. 9. The construction detail for the proposed silt fence requires reinforcing wire and steel posts a maximum of eight (8) feet apart. Omission of the reinforcing wire is a construction change that necessitates more posts for support, i.e., the spacing distance needs to be reduced to no greater than six (6) feet apart (E&SC Planning & Design Manual 6.63, Rev. 6/06). 10. Because the sediment traps and basins are shown on the plan as the primary sedimentation and erosion control devices on this project, it is necessary that the traps and basins and their collection systems be installed before any other grading takes place on site, and that every structure that receives more than one acre of drainage is built so that each dewaters only from the surface (NCGO 10000). If that proves to be impractical, a revised plan must be submitted and approved that addresses erosion and sediment control needs during the interim period until the traps and basins are fully functioning (113A-54.1(b)). 11. A graveled construction entrance must be located at each point of access and egress available to construction vehicles during the grading and construction phases of this project. Access and egress from the project site at a point without a graveled entrance will be considered a violation of this approval. Routine maintenance of the entrances is critical (113A-54.1(b)). 12. As a condition of the NPDES General Stormwater Permit (NCG010000), the financially responsible party shall comply with the NCG01 Ground Stabilization and Materials Handling requirements that became effective April 1, 2019. With regards to the other two items you noted in your email as items that we will need to address as part of the submittal package.... 1. It appears that offsite drainage area may be directed to the SCM via FES #27. The design volume of SCMs shall take into account the runoff at build out from all surfaces draining to the system. Drainage from off - site areas may be bypassed from the SCM. If offsite drainage from property not owned by the applicant or not part of the development project cannot be bypassed, the offsite area must be considered at its built -out potential (i.e. using zoning, considered at 100% impervious, etc.) or there must be a recorded deed restriction for BUA between the parties to treat that amount of BUA in the proposed system must be provided. We will modify the plan to create a bypass around the pond for the water draining to FES #27. 2. It appears that some BUA runoff is directed to the main pool of the SCM via EOP #03. Any runoff that drains to the main pool before the forebay would short circuit the system. When submitting the submittal package, please ensure to provide grading information to support that the runoff from all BUA will be directed to the forebay. We will modify the plan to direct the water from the EOP#03 to the proposed forebay. We are working hard to keep this project on track and get it scheduled for the express review. This comment is referring to the potential of a surface water onsite. One resource to check for potential surface waters onsite is the NC Surface Water Classifications website. Changing the base map to the USGS National Map and the USA topo map can be a helpful resource. When I checked this resource, I noticed there was a blue line feature onsite. If there is a surface water, the vegetated setback rules will apply. Pleaser reference 15A NCAC 02H.1003(4) for the vegetated setback rules. There is just one item that needs to be addressed before it is considered complete and ready to schedule: 1. Upon further review of the USGS and USA maps, it appears there is a blue line feature onsite (see attached) which may or may not be considered a surface water. If this feature is considered a surface water, a 50 foot vegetated setback measured from the top of bank would be required. in order to confirm whether this feature is a surface water, please coordinate with Holley Snider with DWR (cc'ed) as DWR is the group that has the authority to make these determinations. I have already contacted her about this one, so she knows to look out for your correspondence. If the feature is not considered a surface water, once I have confirmation from DWR this request will be ready to schedule.
