Mr. Mills,
I have conducted a review of the proposed project and require more information to complete my review. Please
provide responses to the items below at your earliest convenience.
In order to document that the proposed impacts are the least amount practical to accomplish the project, please
provide further details on how 142 linear feet of stream impact was determined to be the least practical.
One hundred forty-two linear feet of stream needs be impacted to safely access the eastern portion of the
site. Our filling operations must stay 100 linear feet off the property line. As shown on "Creek Crossing
Detailed SI-1 Sealed," we need the stream impact to slope the existing and final grades of the landfill to a safe
and required 3 feet horizontal to 1 foot vertical. Only clean, structural fill (No LCID debris) will be used in the
50 feet stream setback area. This slope will be used to safely access the eastern portion of the site during
construction, operation, closure of the landfill, and post -closure monitoring (minimum of 10 years) of the
landfill. Also, we are required to construct a road, as shown on "Creek Crossing Detailed SI-1 Sealed," that
maintains safe grades for fire truck access around the site, which will be dependent on the 142 linear feet of
stream impact.
2. Please note that a standard condition of the 401 certification will be that clean water be routed around the work
area. Please confirm that you will utilize a pump around system or other way to route the spring water around
the area when installing the French drain.
We agree and plan to utilize a pump around system during the construction and installation of the French
drain.
The plan sheet shows that a pipe will be installed to bypass offsite stormwater through the site. The outlet of
this pipe is shown at the 50' buffer at the toe of the proposed slope. The Division is concerned that stormwater
outlet will cause erosion within the buffer slope down to the stream. Please provide any further information or
realign the pipe accordingly.
On page 3 of the PCN under 8.3.e, we stated, "Clean water diversion pipe (415 feet) and rip rap outlet
(dissipator) have been installed." We will ensure and maintain the rip rap dissipator so that water exiting the
pipe flows away from the buffer slope and into the existing 50 feet vegetative stream buffer. The discharge is
also on the outer (farthest from stream) edge of the 50 feet stream buffer to allow for continued water
filtering and energy dissipation before entering the stream below the impacted area.
Please note that the Division is placing this project "on hold" until receipt of the requested information.
