Contractor will contact NC811 prior to excavating. Customer is responsible for removal of all shrubs, trees, stumps and roots, buildings, fencing and other obstructions prior to excavation, unless otherwise listed in this proposal. Sprinklers, electrical lines, septic lines, cable/phone/Internet lines, water lines, and any/all other utilities must be identified and located prior to excavating. It is the responsibility of the customer to replace/repair/relocate any lines damaged during excavation that were unknown at the time of excavation. Any large rocks, building debris, or other unseen obstructions encountered during excavation will be the responsibility of the customer to remove. GROUNDWATER: In the event underground water is discovered, a shallow well point will be installed, a pump will be used to remove the water. Gravel will be used in addition to pump and stop the water during construction. If a spring or any other natural supply of water is tapped; a permanent solution will be required to manage water. Once the pool is filled up the pump will be removed and any additional steps other than temporary pump system will be the responsibility of the customer. Any de -watering that occurs will be discussed and approved with the homeowners via a change order. EXCESS SOIL: Contractor will establish a spoilage pile for excess soil. Excess soil will be used, as efficiently as possible in back filling and grading. Any remaining soil will be removed by contractor at a cost of $450 per 15 CY load charged to the homeowner unless otherwise noted. SPECIFIC EXCLUSIONS: No additional electrical or plumbing, bonding, pressure valves, gas hook-ups, fill dirt, or any other item not specified under this agreement. Any additional soil required for back filling or grading is the responsibility of the customer. Fine grading, seeding, or planting of material is not included. PLUMBING: All piping will be schedule 40 PVC, sized to meet requirements of pool volume. All valves will meet sizing requirements as well. BACKWASH LINE: Twenty feet of backwash line will be plumbed to the backwash port of the filter. Additional line, if needed or requested, will be billed at cost of time and material as an addition to this contract. PUMP & FILTER: Will be placed within fifty feet of waterline pool. Any additional distance will require additional lines and will be billed at cost of time and material as an addition to this contract.The following equipment is included in this agreement. If listed equipment is unavailable or back ordered, Contractor will use of equal equipment. All equipment will be Pentair unless otherwise agreed upon. POOL WATER: Swimming pools must be backfilled in conjunction with initial water fill -up. Because the backfill and Pool fill up is such a slow process the contractor will utilize the water supply from the residence for the initial fill -up of the swimming pool. It will be the responsibility of the customer to maintain appropriate water levels. Municipal or well water will suffice for this purpose. CRANE SERVICES: Contractor will make every attempt to lift the pool of the transport truck and place it in the ground using the excavator that is already on -site for digging. If this is not feasible due to home location, soil conditions, tree or other items in the way or any other conditions that require a crane or tele-handler rental that cost will be passed along to the homeowner. If a crane rental is necessary the home owner will be made aware of the situation as soon as it becomes evident to the Contractor and payment arrangements will be made accordingly. The home owner will have the opportunity to pay the crane company directly for their services. FENCING: The State of North Carolina requires fencing to be installed at a minimum height of four feet around the pool area with self -closing, self -latching gates swinging away from the poolarea.Compliant fencing must be in place prior to the final inspection of your pool. The fencing is the responsibility of the customer. Contractor will install fencing at additional fee if requested by Customer. CONCRETE SPECIFICATIONS: 3000 psi, average thickness of 3.75" with control joints and non-skid, broom swept finish. Concrete will be fiber mix or have metal grid embedded for additional strength. Delivery truck must have access to to pool site. If access is not achievable, a pump truck or hand delivery will be required at an additional cost to the customer. ***NOTE*** DUE TO THE NATURE OF CONCRETE, CONTRACTOR CANNOT GUARANTEE OR BE HELD LIABLE FOR HAIRLINE CRACKS IN CONCRETE DECKING. WARRANTIES: Contractor provides a one-year warranty on the workmanship warranty on the construction of the pool. All equipment and components will follow the manufacturer's warranty. Contractor is not liable for any warranty whatsoever for work completed by customer or anyone hired by the customer. Any changes or additions to this contract will be agreed to via change order and added as an amendment to this agreement. Future change orders will become due as signed and payment may be added to your next milestone payment unless otherwise specified on the change order. WEATHER: Weather conditions greatly affect the construction of a pool. Wet soil increases the risk of pool walls collapsing. Soil conditions will be monitored for optimum conditions throughout construction. Compaction test will be conducted in pool deck areas at the request and expense of the home owner. Contractor will not be held liable for delays due to weather. EXCLUSIONS: This agreement specifically excludes no running of potable water to the pump room, no fencing. Any additional electrical or plumbing services, sump pump into sewer, landscaping of any kind, any additional electrical upgrades to home such as sub -panel, pressure valves, gas hook up and heater ventilation. STATEMENT OF QUALITY: Your pool will be constructed to APSP (Association of Pool and Spa Professionals) standards and J and J Earthworks specifications. J and J Earthworks warrants our installation craftsmanship for one year from completion of construction. Nothing in the above statement shall be deemed to apply to work and material which has been abused or neglected by the customer or their guests. You are entering into a contract whereas you have the legal right under Federal Law to cancel this transaction by midnight on the third (3rd) day from the date that this contract is accepted.
