NCDWR: After review of the submitted permit application referenced above dated 3-May-2023, and NWP-29 (https://saw-reg.usace.army.mil/NWP2021/NWP29.pdf ) State Water Quality General
Certification 4256 (https://saw-reg.usace.army.mil/NWP2021/NWP29_StateWQC.pdf), it appears that an individual 401 WQC is required from the NCDWR for the proposed activities. The ePCN
received by our office on 3-May-2023 provided the nine required elements for an individual WQC and constitutes the Corps initial receipt of the 401 WQC application. Unless NCDWR is
granted a time review extension, a waiver will be deemed to occur if the NCDWR fails to act on this request for certification within 120 days from the date of the complete 401 request.
The reasonable period of time (RPOT) for you to act on this WQC request is 120 calendar days. The date upon which the waiver will occur if you fail or refuse to act on the certification
is 31-August-2023.
