Good Afternoon,
The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete, Stormwater Management Permit
Authorization to Construct (ATC) Application for the subject project on April 19, 2023. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000 - 1062 rules. We are forwarding ATC Permit No. SWA000202, dated May 16, 2023, for the
construction of the subject project and the stormwater system. This permit shall be effective from the date of issuance
and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency
permits that may be required.
The original signed permit package and plans are being mailed to the permittee, Kyle Bilafer, at the following address

I will hold onto our hard copies of this project for 30 days (in case any issues/typos with the permit are noticed and

Reminder: Please be aware that per 15A NCAC 02H .1044(2), the Erosion & Sediment Control (E&SC) permit for this site
cannot be closed out until the as-built stormwater plans for this project are approved by our office.

We received your post-construction stormwater Authorization to Construct (ATC) permit application for the above
mentioned project on 4/19/2023. Reviews under the Fast-Track permitting process can take up to 30 calendar days to
complete. You can see where this project stands in the review queue by emailing me (I have an autoreply set up that has
the review queue on it). Please upload all documents that you mailed into our office through the link provided
below. Be sure to choose the Central Office as the Primary Contact office.

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be
entered into the electronic form by clicking on the “Add Another Post-Construction File Upload” link directly below the
“State Stormwater Information Uploads” section of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads) will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selecting the correct file type ensures that the files are properly named in the electronic repository and it helps
expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan
sheets (such as lighting plans, utility plans, striping plans, sight distance plans, etc…) as these files are not needed for
review.

We received your application for a new Fast-Track ATC post-construction stormwater permit on 4/10/2023. At this time,
the submission is not administratively complete and cannot be accepted for review in its current condition. Please
provide the following submittal items within 30 calendar days (by close of business on 5/12/2023) so that we may
accept the project and begin the review process, otherwise, the project will be returned as administratively incomplete.
2x hard copies of the Application Form (or pages) with the following corrections made (A complete application is
required per 15A NCAC 02H .1043(3)(a)):
Part C2 – Please indicate the post-construction program that this project is subject to (Urbanizing Areas
(Phase 2)).
Part E5 – Please include the on-site surface water area in this table. Surface waters are waters that are
shown on a USGS topo map and the surface area is measured from the top of banks for rivers/streams
and from the normal pool surface elevation for lakes/ponds. There is a surface water running through
the northern portion of the site (per the USGS topo map & existing site plan). Please also revise the
other calculated values (Total Project Area & % BUA) for the project as needed.
Part E5 – The project area is shown as 1,278,449 sf while the property area is shown as 1,268,075 sf.
Please clarify.
Part E5 – The project density value does not appear to be calculated correctly. For a project with existing
BUA, project density is calculated as \[New BUA\] / \[Total Project Area\]. 274,389 sf / 1,278,449 sf ≠ 26.2%.
Please revise as needed.
2x hard copies of a construction sequence discussing how any future development on the project may be
phased. This item is required per 15A NCAC 02H .1043(3)(g). The construction sequence does not need to be
lengthy, just a brief description of how future development on the project (beyond what is shown on the
plans) will be phased. If no future development is planned for the project, you can simply state that in the
construction sequence. This item is different than the E&SC sequence of construction.
2x hard copies of a plan sheet with the following corrections made:
Wetland delineation or a note on the plans stating that there are no wetlands located on-site. This item
is required per 15A NCAC 02H .1043(3)(f) and Part F4 of the Application. Please also list the name of the
individual that made this determination in a note on the plans.
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brought up during the engineering review.

NOTE: The Standard Application for this project received by our office on April 4, 2023 is being returned as a project
can only be accepted into one review queue/permitting path. Since the previously submitted Standard Application

submittal items are being used for the Fast-track Application items, there will be no return package sent to the
Applicant.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the Fast-Track permitting process can take up to 30 calendar days per statute (one of our
two reviewer positions is currently vacant).
