Dear Mr. Hamrick:
On June 8, 2023, Shelton Sullivan with the Division of Water Resources (DWR) conducted an on -site review
of feature UT5 located on the subject at your request to determine if it would currently rate as a stream
and be applicable to the above -noted state regulations. The following staff were also present for the site
visit: Blake Hartshorn and Ryan Hamilton with the DWR.
The DWR has determined that features listed as "subject" to the Randleman Buffer Rules in Table 1.
below and identified on the attached maps are approximately shown on either the most recently
published NRCS Soil Survey of Randolph County, or the USGS National Map at
https://apps.nationalmap.gov/viewer/, and/or been located on the ground at the site and possess
characteristics that qualify them to be at least intermittent streams or water bodies in accordance with
the NC Stream Identification Manual v.4.11, or determined to be a ditch or manmade conveyance that
delivers untreated stormwater runoff from an adjacent source directly to an intermittent or perennial
stream. Please be aware that features identified as "not subject" may be considered jurisdictional
according to the US Army Corps of Engineers and subject to the Clean Water Act.
DWR file review revealed that feature UT5 was included in a previous project version for this mitigation
site and was mapped with the starting point approximately 25 ft. south and upstream of the previously
existing road. During the June 8, 2023 site review, DWR observed that the road and culvert had been
removed as apart of the project and the stream bank was unstable. DWR approximated the start location
of UT5 and agreed that the stream was intermittent at that point as previously determined in 2011.
Upstream of the start point, the feature rated as an ephemeral stream and extended to Wall Brothers Rd.
Note that this stream has highly erodible banks and impacted from agricultural practices adjacent and
upstream of the feature.

This on -site determination shall expire five (5) years from the date of this letter. The owner (or future
owners) should notify the Division (and other relevant agencies) of this decision in any future
correspondences concerning this property. Landowners or affected parties that dispute this
determination made by the Division may request a determination by the Director of Water Resources.
This determination is final and binding, unless an appeal request is made within sixty (60) calendar days
of the date of this letter to the Director in writing.

This letter only addresses the applicability of the stated regulations on the features identified on the
subject property and/or within the proposed project or easement area. This letter does not approve
any activity within buffers or within waters of the state. There may be other regulated waters, streams
or other features located on the property that do not appear on the maps or table referenced above. Any
waters, streams, or other features on the site, including the features identified in this letter, may be
considered jurisdictional according to the US Army Corps of Engineers and subject to the Clean Water Act.
