RE: Nationwide Permit 3 Application — Tryon Drive Drainage Improvements

Dear Ms. Elks and Mr. Turlington:
On behalf of our client, the City of Fayetteville, Kimley-Horn is submitting the attached application for
authorization under Nationwide Permit (NWP) 3 for the above referenced project in Cumberland
County, NC. The project proposes to upsize approximately 1,700 linear feet of pipe conveyance
drainage infrastructure and replace approximately 1,600 linear feet of asbestos concrete waterline
along Tryon Drive and Swann Street in Fayetteville, NC. The proposed project is necessary to address
reports of flooding of Stream S1 identified within the project study area due to undersized drainage
infrastructure. The area has been analyzed by various consultants and evaluated as part of the Little
Cross Creek Watershed Study, which verified that the project area regularly floods and is not meeting
current level of service requirements. The approximately 2.41-acre site is an assemblage of parcels
situated northwest of downtown Fayetteville, within the Cape Fear Watershed.
Kimley-Horn staff delineated the project area on April 18, 2023 and identified one (1) potentially
jurisdictional stream (Stream S1). A Preliminary Jurisdictional Determination request is being submitted
along with this permit application and has been attached.
The proposed project will include the extension and replacement of existing drainage structures, which
will result in unavoidable impacts to stream S1, a tributary to Little Cross Creek. Proposed channel
realignment is limited to the minimum necessary for the replacement of the existing drainage structures
and channel stability.
• At Impact Site 1, temporary impacts to stream S1-INT and S1-PER will result from the
temporary construction access necessary to construct the project. Additionally, permanent
impacts to stream S1-PER will result from the proposed culvert replacement and extension.
• At Impact Site 2, permanent and permanent -no net loss (P-NNL) impacts to stream S1-PER
will result from the proposed channel realignment and culvert extension. The re -alignment is
necessary to accommodate the proposed end walls being installed to enhance slope and
channel stability around the culvert outlet and inlets. Due to proximity of the existing stream to
the existing roadway, sufficient space is unavailable to install the necessary culvert end
treatments in the correct location.
• At Impact Site 3, permanent, P-NNL, and temporary stream impacts to stream S1-PER will
result from the proposed culvert extension, keyed -in riprap outlet protection associated with the
proposed culvert replacement and drainage improvements, and temporary construction access
necessary to construct the project.

A total of 140 LF (0.0097 acre) P-NNL stream impacts, 44 LF (0.0043 acre) of permanent stream
impacts, and 49 LF (0.003 acre) of temporary impacts would result from the proposed project.
Temporarily impacted areas will be returned to pre-existing contours upon completion of the project.
Compensatory mitigation is not proposed as part of this permit application due to minimal permanent
impacts to streams (<0.02 acre; <300 LF) resulting from the proposed project.
