Baxter continues to explore a wide range of temperature assessment and control options, on track with the target dates outlined in the Temperature Compliance Schedule JCS). The following are the enumerated responses requested within the letter: 1. Official Submittal: Any requests should be officially submitted to DWR for consideration along with a revised / updated copy of the May 1, 2023 "Temperature Study Submittal ". Response: At this time with the exception of item #4 below Baxter's internal process is on track to meet the TCS compliance dates. 2. Temperature Variance: As discussed during the meeting variances are difficult to secure and require EPA approval. If the goal is to seek a temperature variances, please submit an official request. Be cognizant of the fact that variance request include a significant public process. Response: It is Baxter's intent to perform an extensive evaluation of our thermal wastewater discharge and the characteristics of the North Fork Catawba River in the vicinity of the facility to determine if a Clean Water Act Section 316(a) variance from the trout stream temperature standards is appropriate. Based on the information Baxter has obtained to this point, it appears compliance with the temperature standards for non -trout Class B waters will assure the protection and propagation of a balanced, indigenous population of shellfish, fish and wildlife in the receiving water. 3. Re -assessing Water Classification(s). As discussed during the meeting, changing existing water classifications is a lengthy and difficult process. If the goal is to request a classification change, please submit an official request. Be cognizant of the fact that such request / change(s) include a significant public process. Response: It is not Baxter's intent to change the exiting water classification(s). 4. Additional Time: If you wish to request an extension of the September 1, 2023 deadline to submit the Corrective Action Plan specified in Condition A. (3) of the NDPES permit, Baxter Healthcare Corporation PO Box 1390, Marion, NC 28752 T 828.756.4151 please submit an official request with a complete explanation of the reasons why an extension of time is necessary. This additional time maybe provided via a minor permit modification (per 40 CFR Part 122.63), provided the new date(s) are not more than 120 days after the interim compliance date(s) specified in the existing permit and it does not interfere with attainment of the final compliance date (March 1, 2026). Otherwise, this request (if justified), would require a major NPDES permit modification. Response: Per item #1 above and the June 1, 2023 submittal, Baxter has requested a 120 day extension of the Corrective Action Plan submittal deadline. This is to facilitate as complete an assessment of available options as can be achieved within the time provided. In addition, the extension will afford Baxter an opportunity to obtain additional surface water temperature and environmental data regarding the receiving stream in the vicinity of the facility. No other timelines within the TCS require revision/extension currently. S. All Contributing Flows: Evaluate and include in revised / updated report (including a revised / updated Table 2-1) each flow from the facility with any thermal contribution to influent (not only major ones) such as boiler blowdown, DW Auxiliary, sterilization, extrusion, cooling tower blowdown, overflows, etcetera. Include in this evaluation at a minimum the: flow, temperature, and destination (e.g., Cooling Recirculation or WWTP) for each flow with a thermal contribution. For the overflow from the cooling ponds that is sent to the WWTP, this evaluation should also include an explanation of the circumstances under which overflow is sent to the WWTP, the frequency of overflow, the volume/flow of overflow, the temperature of overflow, and the impact of overflow on the effluent temperature. Appendices A and B of the submitted study should be revised as necessary. Response: Attached is a revised water and temperature balance figure (Figure 1) and table (Table 1) of heat each process and the conditions resulting in wastewater discharge. The. The discharges from these sources are not overflow as defined within NPDES permitting/operation conditions because, 1. These discharges do not bypass the wastewater treatment facility and, 2. The systems equipped with high level bypasses allowing gravity discharge to the wastewater treatment facility contain treated water in a retention basin for temperature reduction and emergency water supply management. 6. Data Richness and Diurnal Monitoring: Data richness plays an essential role in compliance determination and next steps. Please provide diurnal monitoring results (hourly or more frequent) for the effluent in comparison with ambient air temperature, and heat exchange capacity. Response: Please find attached a table of the requested data currently available (Table 2). Upstream, downstream, and effluent temperatures are from the Jacobs Engineering fish community study. The wastewater treatment facility has effluent temperature data that currently can be tracked in three-hour increments. The facility is not equipped with a data logging weather station to be able to provide ambient air temperature, if required this would be sourced from the nearest publicly available weather station data. As the facility does not have ambient air temperature data a heat exchange capacity cannot be provided within the 30 day timeframe. This is expected to be part of the assessment within the Corrective Action Plan, as this information will directly inform the viability of mechanical heat exchange. options.. 7. New Monitoring Data and spreadsheet Format: Provide the new monitoring data from this study (excluding eDMR) in an original spreadsheet format for further examination. Response: An excel file of this data and the table referenced in item #6 is included with the electronic submission of this response letter. 8. Fish Community Study: Provide fish community study results. Response: The finalized report prepared by Jacobs Engineering is attached (Attachment 1). 9. Details on New Operations: Provide evaluation for adopting new operation plans due to FDA requirements in comparison to current operation status in regards thermal contribution to effluent. If such evaluation is not feasible currently, please provide a timeline on when it would be available. Response: FDA compliance for pharmaceutical products is based on achieved results, and therefore no explicit regulatory rules governing new operational plans or projects can be referenced. The requirements for sterilization are a performance -based standard, i.e., Baxter must ensure that its product is sterile, with no acceptable levels of bioburden in final sterilized product. The North Cove site's terminally sterilized drug products are manufactured in accordance with the site's comprehensive control programs that, among other things, ensure that: • pre -sterilization bioburden is adequately controlled; • terminal sterilization is effective; • bacterial endotoxin testing (BET) meets established specifications prior to release • the primary packaging of the site's products is integral. The North Cove facility integrates process improvements designed to control bioburden prior to sterilization. The currently planned operational updates related to this as well as WWTP discharge are: • WFI 2.0 — A replacement system of our current water distribution system for solutions mixing. This will be entering validation during summer of 2023, expected to be significantly complete before end of 2023. During validation an increase of approximately 40,000 gallons of heated water will be produced. After validation a storage tank currently used as part of the active WFI system will be used as a holding vessel for boiler re -use. This is a production side component that will be part of the engineering assessment within the Corrective Action Plan. WFI 2.0 is a key part of our new mixing system as well as providing significant control and process improvements over current WFI water distribution. • North Mixing — A new solutions mixing facility utilizing bulk container raw material loading and closed system mixing, greatly reducing the potential for contamination within solutions resulting in one-off discharged batches of solutions to the WWTP. 10.
