Thank you for your submittal of the information on June 15, 2023. Your submittal of the
information attached to this correspondence satisfies, in full, the non-compliance of the
negative credit sales from the Evans Ballahack bank. Thank you for your prompt attention to
this matter.
By copy of this correspondence, the Division of Water Resources lifts all holds previously placed
on credit sales by Greene Environmental Services, LLC from the Baldwin Swamp and Evans
Ballahack bank sites. Please copy me on the emails that you send to the City of Greenville and
to the Permittees, notifying them of the new Credit Transfer Certificates.

My apologies. I tend to take a back seat with GES, LLC unless I'm specifically asked for assistance.
I've read through your emails and believe I have stated everything as you have requested.
Please see the attached documents.
1. Evans Ballahack Ledgers
a. I deleted the Nitrogen Credits we tried to refund from this ledger.
b. I updated the date on the Phosphorus credit refunds, added the verbiage you
requested under the Project column, and switched the pounds of phosphorus to
denote credits released instead of negative credits sold.
2. Baldwin Swamp Ledgers
a. I deleted the Nitrogen Credits 'sold' that we tried to move between ledgers.
b. I updated the Phosphorus credits issued to denote the verbiage you requested.
3. Mitigation Credit Transfer Certificates for the refunds and re -issues of solely Phosphorus
credits (4 letters).
a. All are dated June 7th and denote phosphorus credits only.
b. 2 are refunds
c. 2 are issues
I believe I checked all the boxes per your very helpful, descriptive e-mail. Please let me know if I
missed anything.

Good Afternoon Jeff,
I am still on vacation, but I have taken the time to respond to your question. As a courtesy, I
have taken the documents that Salina provided on June 13, 2023 in response to the email I
provided GES on June 7, 2023 and I have combined all the correspondences into one
document, which is attached to this email for convenience. This document is titled "GES-DWR
Correspondence —Non-compliance Phosphorus sales", and includes the following items:
• DWR original email from Katie Merritt to Jeff Becker, Salina Campbell and Trisha Crawford
on June 7, 2023 with clear and concise instructions on how to satisfy the non-compliance
of the overselling of Phosphorus credits
• June 10, 2023 Evans Ballahack Ledger submitted by Salina on June 13, 2023
• June 10, 2023 Baldwin Swamp Ledger submitted by Salina on June 13, 2023
• Revised Mitigation Credit Transfer Certificates submitted by Salina on June 13, 2023
Additionally, I have taken the time to add comment boxes adjacent to each issue on all the
documents above. The comment boxes are included in the attached document for your
convenience. You will need to review the comments in ADOBE by clicking on the comment box
in order to read the full text of the comment. Please take the time to review my comments in
the attached document. At this time, DWR cannot do anything further to assist GES than what
has already been provided. GES needs to give DWR the required documentation in order to fully
resolve the non-compliance issues. Until then, GES still cannot sale phosphorus credits from the
Evans Ballahack nutrient offset bank or the Baldwin Swamp nutrient offset bank. If you have

When you say of the document. I do not understand. the letter to the i wrote to the clients matches
the situation that has occurred.. the language in the letter you forwarded implies the credit
purchaser is somehow must do x y z.. Is my letter Refund Of Credit Transfer at issue also ??/ I have
contacted Trisha.. CEO of Ham Farms and asked her to personally review and correct the ledger
issues.. Se will have them corrected Thurs Pm.. Please advise what corrective action is needed
concerning my attempt to inform our clients that we had to refund and reissue credits etc. thanks

Good afternoon Jeff, I have looked at the documents that Salina prepared in response to the email I
sent last week. None of the documents including the corrected ledger and Certificates match the
instructions that were provided from DWR to satisfy the noncompliance. The dates do not match, the
verbiage required to use is not on the ledger, there is a debit instead of a credit, etc. Additionally, GES
refunded Nitrogen credits in addition to the phosphorus credits which was not included in the audit
Review for the phosphorus non-compliance or In the instructions that we prepared for GES. DWR did
not audit the Baldwin Swamp Nitrogen ledger to confirm nitrogen credit availability. GES is not
authorized to refund the nitrogen credits from the Ballahack bank for those transactions. Please go
back to the email I issued last week regarding specific and clear instructions on how to satisfy the
noncompliance for the phosphorus credit sales only.
DWR will lift the hold on phosphorus credit sales in the tar Pamlico 03 for GES to sell phosphorus
credits from other tar pamlico 03 phosphorus banks. However, GES has still not resolved the non-
compliance in accordance with the instructions from DWR, and this must be done. Therefore, GES
Cannot sell phosphorus credits from the Ballahack bank or the Baldwin Swamp bank until this issue
has been resolved. You are allowed to sell phosphorus credits from any of your other Tarr Pamlico 03
banks.

referenced project. This project is located in the jurisdiction of the City of Greenville which is
required to implement stormwater management requirements as part of the Tar -Pamlico Nutrient
Strategy. The City of Greenville must review and approve developers' stormwater management
plans which are to include options to offset nutrients loads occurring at the development site.
Payment into a private mitigation bank is acceptable per this nutrient strategy rule. The -City of
Greenville specified and verified the amount of the nutrient offset necessary for approval of the
stormwater permit as 120 lbs. of phosphorus, Osq ft buffer credits.
You must also comply with any other state, federal or local government permits or authorization
associated with this activity including SL 2009-337, An Act to Promote Compensatory
