Referring to the property located at 719 Cannonsgate Dr, Newport, Carteret County, (a .015 acre filling project behind an existing retaining wall for a single family residence), the Corps has rescinded their preliminary 404 wetland determination and said Corps action is longer needed and work can resume. You had issued a 401 Certification which I suppose was predicated on the preliminary 404 call made by the Corps. I have requested a refund for the CAMA Major Permit application for our client since a CAMA Major Permit is no longer needed, at least from what I can think of based on my experience (see my explanation in the email below to the CAMA folks). Before they agree a CAMA Major was not needed, they want to ensure that there was no other authorization needed from DWR on this project. Unless I am missing something, please let me know if there are any other authorizations needed from DWR other than the previous 401 Cert. I think I covered them all in my email response below, but you have the final say in this. Well, its not coastal, its not 404 (404 and 401 go hand in hand — that's what they issued was 401 Cert — see attached cert; and the 401 expires when the 404 expires as per the certificate language, so if there is no 404, well,... just saying), and its not a stream or basin buffer (zone 1 or 2), and DWR isolated wetland permit is needed only if you fill 1/3 acre or more (.33 acre or 14,375sf) east of 1-95 and this was only 600sf or so for the total project, not just the smaller area they thought was wetland, and a state stormwater permit is only needed if a CAMA Major Permit is needed (which its not anymore)—, so not sure what else JD DWR would have? But I can run it by Michael at DWR and see what he says, but let Jonathan know I said the attached 401 cert speaks for itself O and study up on his DWR rules. After reviewing the additional information provided by both you and the NC DCM, based upon our June 13, 2023 field visit, the area proposed for fill, located landward of the retaining wall does not meet the required three parameters for 404 wetland criteria.
