RE:Walnut Cove (Major Modification), Spring Hope, Nash County
This letter is written in response to the red-lines and comments datedJune 15th, 2023, regarding
theMajor Stormwater Modification ApplicationforWalnut CoveSubdivisioninNashCounty, NC.
A reply or explanation for each comment issued by your office is provided below and follows the
original format of your memorandum.
Sketch Plan Review Notes:
1.Application (A complete Application is required per 15A NCAC 02H .1042(2)(a)):
Please provide pages 2, 4, 5, & 6 of the Application (a complete application is required for a
major modification).
a.Section II, 1.b. – Per satellite imagery from November 2021, construction appears
to have already begun on the site. Please indicate “Partially Completed” (or
“Completed” if appropriate) and provide a partial designer certification (the
designer certification forms are attached to the original permit, complete and
return as much of them as you can at this point, see later comment).
Noted, we have provided the remaining application pages and Partially completed
certification.
b.Section IV, 7 – Please exclude the onsite surface water area (Section IV, 6) from
the total property area (Section IV, 4) to get the total project area.
The onsite surface water is now excluded from the total property area. Please see
attached.
c.Section IV, 10 – There appears to be an issue with the BUA accounting for DA 1.
The sum of the BUA items in the lower half of the table do not add up to the total
BUA (it appears to be a rounding issue).
We have fixed the impervious area to this column to the correct amount. Please
see attached.
2.Please sign and seal the design calculations. This item is required per 15A NCAC 02H
.1042(2)(f) and Section VI, 7 of the Application.
A signed and sealed calculations cover has now been provided. Please see attached.
3.Please provide the property deed for the Phase 2 area of the project. This item is required
per Section VI, 10 of the Application.
The deed for the Phase 2 project area is now provided. Please see attached.
4.Please provide the title & position information for the signing official and proof that the
Applicant is in good standing with the NC Secretary of State (if applicable). This item is
required per 15A NCAC 02H .1042(2)(b) and Section VI, 11.
Proof of the title and position of the signing official and proof that the applicant is in good
standing with the NC Secretary of State has now been provided via a printed screenshot
from the NC Secretary of state website.
5.Please delineate the wetlands on the plans or include a note indicating that there are no
wetlands located on-site (with the name of the individual that made this determination).
This item is required per 15A NCAC 02H .1042(2)(g)(iii) and Section VI, 8m of the Application.
We have added a note to the plans that states, “There are no wetlands located in this phase
of the project.” Please see CE-00 attached.
6.Please provide proof that the Operation & Maintenance Agreement has been recorded with
the register of deeds (Required per 15A NCAC 02H .1050(11)).
The pond in phase 1 has not been converted to a wet pond at this time. Therefore, the
Operation and Maintenance Agreement has not been recorded.
7.Please provide a Designer’s Certification for the project. This item is required per Section
II.1.b of the Application. The certifications can be found in Attachment A of the cover letter
& permit (attached).NOTE: Since the site is only partially completed, complete as much of
the certification forms as you can.
The designer’s certification has been filled out and provided for a partial certification. Please
see attached.
8.Please provide proof that the deed restriction documents have been recorded with the
Register of Deeds. This item is required per 15A NCAC 02H .1042(2)(k). If the property has
not yet been sold off, please clarify if the lots in Phase 2 will be subject to the same deed
restrictions as the lots of Phase 1.
The recorded deed restrictions for the site have been provided. Please see attached.
9.Please provide proof that the drainage easements have been recorded with the Register of
Deeds. This item is required per 15A NCAC 02H. 1042(2)(l).
The recorded plats of the site have been provided. Please see attached.
Please note we have updated the Supp-EZ form as requested as well. Please see attached.
