Dear Mr. Phillips and Mr. Thomas,
On behalf of Mark Lyczkowski, we are providing a response to the Request for Additional Information (RAI)
email received on March 3, 2023, for the South Carter Industrial site, an approximately 141.9-acre site
located in Sanford, North Carolina within Lee County (the Site).
The revised Impact Maps have been attached showing adjustments to stream impacts 2, 3, 4, and 5, due
to the Ordinary High -Water Mark (OHWM) measurements completed by Timmons Group personnel on
04/17/2023 at impact locations and design/limits of disturbance (LOD) adjustments. The results of the field
work confirmed stream widths were smaller than originally depicted on the previously submitted Impact
Maps. Additionally, due to the LOD changes, there are only five impacts rather than six that were depicted
on the original Impact Maps.
More -detailed depictions of the culvert installations at impacts 2, 3, 4, and 5 have been provided. These
include profile sketches depicting the proposed culverts. All other impact amounts remain the same as
reported in the Pre -Construction Notification (PCN) application dated 02/03/2023.
The comments are outlined below in italics and are grouped by impact, with USACE comments in blue. Our
response is below each comment.
1) USACE comments
1. Based on the information provided in the PCN, the applicant is requesting the use NWP 39 to
conduct the proposed activities, which would result in a loss of 0.07 acre of stream bed. Per Regional
Condition B. 5., NWPs may not be used for activities that result in the loss of more than 0.05 acres of
stream bed, except of NWP 32. As such it appears that the project as proposed does not qualify for
authorization under NWP 39 as requested.
a. You may apply for the proposed project via the Standard Permit process, or, as an
alternative, you may further avoid or minimize impacts to meet the conditions of NWP 39.
ENGINEERING I DESIGN I TECHNOLOGY

The overall project design has been adjusted to avoid and minimize stream impacts to the
maximum extent possible. The project will now result in a loss of 0.048-acre of stream bed, which
is below the 0.05-acre threshold of stream bed impacts. Therefore, the project as proposed will
qualify for authorization under NWP39.
2. Per General Condition 2, no activity may substantially disrupt the necessary life cycle movements
of those species of aquatic life indigenous to the waterbody, including those species that normally
migrate through the area, unless the activity's primary purpose is to impound water. All permanent and
temporary crossings of waterbodies shall be suitably culverted, bridged, or otherwise designed and
constructed to maintain low flows to sustain the movement of those aquatic species. In order to verify
compliance with GC 2 please provide profile sketches depicting the proposed culverts.
The attached updated impact maps now include profile sketches of the proposed culverts located
at impacts 2, 3, 4, and 5.
