Project Description and History 4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: NC Land Cover Categories that generally occur on site: (1) Forest Land — Needleleaf Coniferous Forest Land — Loblolly-Slash Pine Forests; (2) Forest Land — Broadleaf Deciduous Forest — Oak -Hickory Forest; (3) Herbaceous Cover and Shurbland - Unmanaged Herbaceous Cover - Other Unmanaged Herbaceous Cover (clear-cut areas); (4) Water Bodies - Linear Drainage and Inland Water Bodies(wetland and streams). Current Site Conditions: The subject property is currently comprised of a of a site that we believe has been managed for timber purposes. The majority of the site was clear-cut in late 2019-early 2020. Jurisdictional waters of the US on site were classified according to USACE and NCDWR guidance. The results of the jurisdictional determination investigation indicated that there were four jurisdictional streams present within the subject property (SA, SB. SC and SD/SE/SF). Stream SA is a perennial unnamed tributary that eventually flows into Mile Branch. Stream SB is an intermittent unnamed tributary that flows into the perennial UT to Mile Branch. Stream SC is also an intermittent unnamed tributary that flows into the perennial UT to Mile Branch. Stream SD/SE/SF is a perennial unnamed tributary (that becomes intermittent in its headwaters) that flows into the perennial UT to Mile Branch. In addition to the four jurisdictional tributaries, there was seven jurisdictional wetlands located within the project area. Wetlands WA, WB, WC/WD, and WE have been clear-cut and the forest cover removed except for areas near Stream SA (stream buffer). Wetlands WG, WH and WJ are all forested wetland areas. Wetlands WA, WB, WE, WG, and WH will not be impacted by the project. The project area is within the Cape Fear River Basin (HUC#03030003)(USGS 1974). Land use in the vicinity of the project consists of mainly residential and commercial/industrial land with some undeveloped areas still present. 4b. Describe the overall project in detail, including the type of equipment to be used: * The overall project includes the proposed construction of Phase 3 of the Baker Park residential subdivision. The overall residential subdivision will consist of approximately 106 single family residential lots. Three impact areas are proposed for this site in order to facilitate sufficient access to the site. Impact #1 contains both a wetland and stream impact for a road crossing and some lot fill (permanent wetland fill impact = 0.044-acre; permanent stream fill impact = 54.35 LF (0.005-acre); temporary stream impact = 5 LF (0.0004-acre)). Impact #2 consists of a wetland fill area for a road crossing (permanent wetland fill impact = 0.424-acre). Impact # 3 is a bottomless culvert road crossing that will have a shading impact on the stream reach (permanent stream shading impact = 74.2 LF(0.01-acre). To facilitate the development of the site, clearing and grading the site is necessary. Graders, haulers, excavators and other heavy equipment will be used during grading and construction of the site. 4j. Federal and State Threatened and Endangered Species Evaluation The USFWS iPac official species list indicates species with the potential to inhabit the Baker Park site. The official iPac Species List identified two species that are considered either Federally Threatened or Endangered. Those two species are Schweinitz's sunflower (Helianthus schweinitzii) and small whorled pogonia (Isotria medeoloides). Two other species occur on the list Tri-colored bat (Perimyotis subflavus) and Monarch butterfly (Danaus plexippus), but do not require consideration currently as they are listed as "Proposed Endangered" and "Candidate" species, respectively (no consultation required, currently). LEES evaluated the project study area for potential habitat for the two federally listed Threatened (T) or Endangered (E) species that occur on the official species list from the USFWS iPac system. The habitat evaluations took place during the delineation of the site in late October. Schweinitz' sunflower (E) tends to grow in soils that are thin, and generally occur on upland interstream flats or gentle slopes, on soils that are clayey in texture, and, when weathered from metasedimentary rocks, often contain large quantities of slaty rock fragments. This species also inhabits generally open areas, with abundant sunlight and little competition from other vegetation. The majority of the project site was forested prior to late 2019 and had been for many years. Sometime in late 2019-early 2020, the site was clearcut, except for the stream buffers and the site is now going through primary succession. Habitat potential for Schweinitz's sunflower would be considered low for this area, due to the forest habitat present pre-2020 and the successional state the tract is currently in. The review of the project area during the habitat evaluations revealed no individuals of Schweinitz' sunflower present on site. NCNHT records review indicates that there are no populations that occur within a one -mile radius of the subject property. Since the habitat potential is low and no individuals were observed on site during the delineation effort, we would propose a biological conclusion of No Effect. Ground cover can be sparce or somewhat crowded. Canopy openings are important for thriving populations. Soils within existing populations are generally poor and acidic and can have high moisture contents. The majority of the project site was forested prior to late 2019 and had been for many years. Sometime in late 2019-early 2020, the site was clearcut, except for the stream buffers and the site is now going through primary succession. Habitat potential for small whorled pogonia would be considered low for this area, due to the the successional state the tract is currently in. The review of the project area during the habitat evaluations revealed no individuals of small whorled pogonia present on site. NCNHT records review indicates that there are no populations that occur within a one -mile radius of the subject property. Since the habitat potential is low and no individuals were observed on site during the delineation effort, we would propose a biological conclusion of No Effect. Biological Conclusion: No Effect Summary Habitat for Schweinitz's sunflower and small whorled pogonia would be considered low due to the presence of early successional state of the tract. These low -quality areas were evaluated and no individuals were found during those evaluations. LEES would not recommend additional survey work for any of the species listed. How do I know if a bird is breeding, wintering or migrating in my area? To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the profiles provided for each bird in your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3.
