Your response addresses the Division's request, with the exception of number 3. It's not clear from the response to number 3 how streamflow will be maintained below the pond during pond re -fill following construction. This may, or may not, be a concern depending on climatic/precipitation conditions at the time of construction. The Division must ensure there is adequate streamflow downstream of the work to maintain aquatic habitat. I propose including a condition in the Certification that states: Streamflow must be maintained within the stream channel downstream of the pond at all times, including during construction/maintenance activities and pond refilling. A minimum of 50% of stream inflow shall be maintained in the receiving stream at the pond outlet at all times, including refill. Please let me know if this condition is acceptable, or alternatively, propose a minimum flow number at the pond outlet that will be maintained and that is adequate to ensure downstream habitat is maintained during construction work. Andrew, I have attached our response package to the additional information request for the Blair 4794 project in Jackson County. We have included the revised impact map and a copy of the WRC comment letter for the trout moratorium. We will be submitting the JD/Hazard Classification request to Josh Colley early next week per his recommendation. We are coordinating with Dam Safety concurrently to requesting the 404/401 as completing the work before the trout moratorium is critical due to the current instability of the site entrance. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. If not already done so, the Division recommends the owners contact the North Carolina Dam Safety Program to determine any requirements from that program for the proposed work. Josh Colley (iosh.colley@deg.nc.gov) is the State Dam Safety Engineer. [15A NCAC 02H .0506(b)(3)] 2. The proposed spillway profile and cross section figures provided with the PCN do not have units depicted along the axes or a clear scale. Please revise those figures to include the units of measure along the axes. [15A NCAC 02H .0502(a)(9)] 3. Please provide a construction sequence for the installation of the spillway and include details regarding whether the pond will be temporarily de -watered and how the work will be conducted such that there is no flowing water over the disturbed area. Please also include details that demonstrate adequate flow will be maintained in the receiving stream during construction to ensure maintenance of biological integrity. [15A NCAC 02H .0506(b)(1), (2), and (3)] 4. It appears, based on the proposed spillway profile, the intent of the project is to retain the pond full pool elevation at, or near, its existing elevation following construction. Please confirm or describe how the full pool elevation will change after installation of the spillway. [15A NCAC 02H .0506(b)(3)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by July 6, 2023. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
