Hi Krysta, I have spoken with our client and they are good with changing this to a NWP27. I have included Andrew on this so DEQ also is aware to change it (DEQ# 20230777). I am curious as to why the applicant would like a NWP 13 instead of a NWP 27 (restoration activities) which does not have a limit on the amount of stream impacts. The NWP 13 typically requires a waiver from me after 500 LF, in addition to that condition, agency coordination (EPA, WRC, STATE, etc) have the opportunity to comment on the project. The main difference would be that the NWP 27 would require photo logs to ensure that the stream restoration is actually an ecological uplift. This is done by photo documentation as a special condition For up to 3-5 years after the project is complete. If the project is not "working" or viable, then re -plantings, would be required. What are the applicant thoughts?
