Please consider this email (including attachments) a formal response to your Requests for Additional Information provided on 4/5/23 and 4/10/23.
Per your suggestion and based on the needs of the project, we would like to formally request that NWP-18 be utilized for permitting the wetland impacts associated with the construction
of the proposed stormwater management facilities(in conjunction with NWP-29 for the remainder of the residential development project). Further details regarding the need for this change
and the justification for the need are provided below and in the attached documents, including revised Impact Maps, Grading Plans, Existing Conditions and Demo Plan, and Exhibit #1
(Lot Impacts).
Please see responses to your questions below in RED as well as the attachments providing additional information and documentation:
1. Your permit application includes plans showing construction of 2 stormwater ponds in wetlands, which does not comply with NWP-29 Regional Condition C.a. (Discharges in streams
and wetlands for stormwater management facilities are prohibited under this NWP). NWP-18 could potentially be used for permitting the stormwater management facilities; however, you
need to provide documentation as to why you cannot further avoid and minimize impacts to these features. Furthermore, based upon your project plans, it appears that the stormwater will
be routed to a different location away from the downstream receiving waters, thereby indirectly impacting the intermittent stream below Wet Pond #2. This is an adverse indirect impact
and needs to be quantified and permitted (possibly mitigated). Understood. Please see revised Overall Impact Map Exhibit that has been revised to show that the primary stormwater pond
outlet for Wet Pond #2 will be directed to the existing receiving downstream waters, therefore not indirectly impacting the intermittent stream. The Grading Plan has also been revised
to avoid the adverse indirect impact (see attached). Another option to you would be to redesign Wet Pond #2 outside of the jurisdictional features in a manner that provides water to
the downstream intermittent stream which would eliminate impacts to Linear Wetland #2 and the potential indirect stream impacts. N/A (The Plan has been revised to eliminate potential
indirect stream impacts so this option not necessary.)
2. Your detailed impacts listed in PCN Section D Proposed Impacts Inventory of the permit application does not accurately reflect the impacts detailed on your Construction Plan
Overall Impacts Map dated 1/2/2023, e.g., Plan Impact #2 on drawing is associated with the stormwater Wet Pond #1, but is listed as “road widening” in your PCN Section D. Please confirm
all impacts and provide updates to Section D of the PCN to accurately reflect your Overall Impacts Map.

*Please note that the changes on this table and the Wetland Impact totals are reflected in the revised impact maps attached to this email. We were able to re-design the offsite sanitary
sewer and therefore reduce temporary wetland impacts (Wetland Impact #1) per the revised Impact Maps.
3. The proposed project to FILL WETLANDS FOR LOT FILL and STORMWATER MANAGEMENT FACILITIES. The need for your proposed road access is not disputed; however, you have not demonstrated
avoidance and minimization to the maximum extent practicable as required by NWP-29 General Conditions 23(a) and (b). For example, it appears that SUCH IMPACTS COULD BE AVOIDED BY not
grading lots 12 and 13 on their southern boundaries. The developers smallest product would not fit on lots 12 & 13 if the southern boundaries of lots 12 & 13 were not graded. I’ve provided
an attached detailed grading plan showing the housing products on the lots for clarity. In addition to this, please see attached Exhibit #1 which shows what it would take to avoid impacting
a portion of Linear Wetland (LW2). Due to the road grades and having to grade down to tie into existing topography, lots 11-14 would not be viable. Losing 4 lots here would significantly
impact the feasibility of the project. In addition, lots 26 and 27 (and a portion of lot 28) involve draining and filling of the pond (P1). Based on our review it appears that lots
12, 13, and 28 would continue to remain viable with modifications to avoid/minimize. Lot 28 would not be viable. See detailed grading plan with housing product shown for clarity as
the width of the product shown is the minimum and cannot be revised to avoid the existing pond. In addition to this, please see attached Exhibit #1 which shows what it would take to
avoid impacting the pond (P1). Due to the road grades and having to grade down to tie into existing topography, lots 25-28 would not be viable. Losing 4 lots here would significantly
impact the feasibility of the project. It is not clear that project viability is dependent on the inclusion of LOTS 26 and 27 being constructed when the overall development proposes
58. The overall development proposes 64 units per the Overall Impact Map Plan. Avoiding the Pond (P2) and Linear Wetland (LW2) features would be detrimental to this project as we would
only be able to construct 56 units and jeopardize the feasibility to develop it. Please re-design the project accordingly or provide documentation that such avoidance and minimization
measures are not practicable (i.e., available and capable of being done after taking into consideration cost, existing technology, and logistics in light of overall project purposes).
Responses to comments and exhibits attached serve as documentation that these avoidance and minimization measures proposed are not practical in these particular cases. We have revised
the plans to avoid and minimize impacts in other areas of the project as shown in other responses.
4. Based on your site plans, currently grading is called for on the east side of lots 26, 27 and 28. These grading activities depict drainage going into a detention basin which
would alter downstream flows to another intermittent stream. Please see revised Overall Impact Map Exhibit demonstrating that the grading has been revised so that the drainage behind
these lots do not go into the detention basin and therefore the downstream flows to the intermittent stream are not indirectly impacted. In addition, we have revised the grading to
avoid impacts to Linear Wetland (LW1). These are additional indirect impacts which need to be quantified and permitted or redesigned to avoid. These indirect impacts have been redesigned
to avoid.
5. “STREET 1” is designed such that it connects to the adjacent properties to the north and south of the proposed project, and “STREET 2” connects to the adjacent property to the
south. It is reasonably foreseeable that the proposed road alignments would require future impacts to wetlands (especially at the northern open stub of STREET 1 where mapped wetland
“W1” would clearly be impacted with STREET 1 extension). Please either re-design this road stub to avoid future impacts to wetlands or other waters of the US, provide a terminus (cul-de-sac/hammerhe
ad) to the streets, or describe why such changes are not practicable. The parcel to the north of our project is an existing cell town site and is currently utilizing an existing gravel
drive through our parcel from Farrington Road in order to access the cell tower. See attached Existing Conditions Plan for clarity on this. Street 1 has been specifically designed and
will be dedicated as public right of way so that it will tie into the existing gravel drive and access is maintained to the cell tower. A turn around/cul-de-sac is not necessary here.
Further, generally provide additional information regarding the designed alignment and future extension of this roadway. N/A

Permit (NWP) 29 Residential Developments. Please submit the requested information below (via e‐mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification
of the use of the Nationwide Permit or consider your application withdrawn and close the file:
