The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. The PCN for the subject project was signed by Julie Bernstorf and lists the project applicant (i.e. the project owner and entity responsible for compliance with the water quality certification) as MountainTrue. Title 15A NCAC 02H .0502(a)(11) requires an agent authorization letter if an agent signs the application on behalf of an applicant. In this case, as the applicant is not the property owner, the landowner authorization signed by the Town of Bryson City does not satisfy the requirements of the aforementioned administrative code. Please provide an agent authorization form signed by MountainTrue granting you signature authority, or alternatively, confirm the Town of Bryson City is the project owner. Please provide additional details regarding the vegetation plan including specific species. The Division reviewed the bare root planting, container planting, and live staking typicals but it's not clear what species are planned nor where they will be planted. A list of potential seed mixes and/or species will suffice. [15A NCAC 02H .0506(b)(1) and (2)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by July 6, 2023. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
