Dear Chief Jones,
On December 7, 2022, the Division of Water Resources (DWR) received an applicaƟon from PR Engineering for an
Individual 401 Water Quality CerƟficaƟon for the Springdale Driving Range Expansion Project in Haywood County. On
January 5, 2023, March 10, 2023, June 15, 2023, and June 20, 2023, DWR requested addiƟonal informaƟon from the
applicant. DWR conƟnues to work with the applicant to resolve water quality related concerns. On March 22, 2023, the
Corps approved a Reasonable Period of Time extension request that extended the review period to July 6, 2023. DWR
respecƞully requests that the reasonable period of Ɵme be extended unƟl October 6, 2023. In support of this request,
we direct your aƩenƟon to the following consideraƟons with regard to consideraƟons listed in RGL 19‐02:
(iv) Unique or Complex Site CondiƟons: The project is an aŌer‐the‐fact applicaƟon submiƩed in response to an
Unauthorized AcƟviƟes leƩer sent by the Corps on January 31, 2022. It proposes to restore 360 feet of an
unnamed tributary (UT2) to the East Fork Pigeon River and impact an unspecified length exceeding 295 feet
of an unnamed tributary (UT1) to the East Fork Pigeon River for the placement of a culvert. The project’s
purpose is to expand a driving range on the golf course. The streams proposed for impact are classified by
DWR as Water Supply III and Trout. DWR conƟnues to work with the applicant to determine the length and
the feature type of impacts, which is complicated by the site’s history of non‐permiƩed impacts and damage
that resulted from Tropical Storm Fred. MiƟgaƟon is required by DWR for the loss of equal to or greater
than 300 linear feet of perennial stream in order to protect the water quality and exisƟng uses within
downstream waters. The determinaƟon of impact length and feature type may necessitate miƟgaƟon to
offset impacts, which will require a miƟgaƟon plan from the applicant.
By making this request, DWR does not waive its right to determine that addiƟonal informaƟon or Ɵme is necessary to
process the applicaƟon. Further, DWR does not waive its right to contest the legality of the Corps’ August 7, 2019,
Regulatory Guidance LeƩer, Corps regulaƟons implemenƟng SecƟon 401 of the Clean Water Act, or any acƟons taken by
the Corps pursuant thereto.
