During the site visit, Mr. Zhang was informed that wastewater generated at the facility from washing filters and basins, overflowed from the wet well of the pump station and entered an unnamed tributary to Rocky River, a Class WS-III; CA stream in the Cape Fear River Basin, and such overflow occurs on.a daily basis (filters are backwashed daily and basins are wished weekly). Wastewater from the facility is supposed to be sent to the Town of Siler City's sewer collection system via a pump station and force main. Accordingly, this letter is being sent to you in order to remedy the subject illegal discharge that was discovered by Division staff. It can also result in a civil penalty assessment of up to $25,000 per day per violation. Please respond to this letter in writing within 30 days of receipt. Your response should be sent to the attention of Scott Vinson at 3800 Barrett Drive, Raleigh NC, 27609, and it should minimally address the following items: 1) Please explain how the illegal wastewater discharge will be eliminated (for example, applying for a discharge permit; applying for a pump -and -haul permit: . upgrade the pump station/force main); and 2) Please provide detailed information regarding how and when this matter will be resolved. Thank you for your attention to this matter. This office requires that the violation, as detailed above, be abated immediately and properly resolved. Environmental damage and/or failures to proper maintain manage your wastewater have been documented for the subject site as stated above. Your efforts to undertake activities to bring the subject site back into compliance is not an admission, rather it is an action that must be taken in order to begin to resolve ongoing environmental issues.
