You need to demonstrate that the swales will be stable for the 10-year design storm in perpetuity. For example, if a
swale will have a temporary matting that is stable up to 10.0 fps and the grass, once established, will be stable up to 5.0
fps, a channel velocity of 7.2 fps in the swale would not be stable in perpetuity (It would be stable so long as the
temporary matting remains in place, but once the matting disintegrates, the channel velocity of 7.2 fps will exceed the
maximum allowable velocity that the grass can handle (5.0 fps) and will cause erosion). I don’t have this submission in
front of me right now, but from what I recall, there were some swales that are similar to the example above (where the
channel velocity of the swale is greater than what the established grass can handle, but less than the velocity rating for
the temporary matting, i.e., these swales will fail once the matting fails). This issue wasn’t brought up for the third type
of matting (I forget what it was called) since, from what I could tell from their website, that matting is a permanent
matting (It had about a 75 year lifespan if I recall correctly). To address the comment, you will either need to
demonstrate that the established grass will be stable once the temporary matting fails or reconfigure the design so that
the swales will be stable in perpetuity.
Please let me know if I need to clarify this further,

Jim:
We are currently working on the requested revisions. With regards to “Prior Comment 2b”, in reviewing the Curlex I &
Curlex II specifications, the material is a temporary measure to enhance ground re-stabilization as stated in Performance
requirements 1.02 for Curlex I and Curlex II specifications (see attachments). The intent of the matting, in both cases
and where shown on the plans, is to support the stabilization (grassing of disturbed area) and is no longer needed once a
stand of grass has been established. As the timetable to establish grass is significantly less than 15 and 30 months, the
longevity of the material would not be a critical factor to stabilization.
With respect to the requested information on this item, does the plan need to show labels indicating matting with
grassing (as that is the intent) to address this comment?

Ravindra,
I was looking over the additional information you provided on June 7, 2022. Everything looks good except for a few small
issues:
Please correct the following:
Prior Comment 2b – The provided specification pages for the Curlex I & II erosion control blankets indicate that
they are not permanent (Curlex I has a functional longevity of no more than 15 months and Curlex II has a
functional longevity of no more than 30 months). The swales must remain stable in perpetuity. Please revise.
Prior Comment 2c – Please provide the sizing calculations for the energy dissipaters downstream of the
stormwater outlets (FES 100, EW 200, FES 300, & FES 400). This item is required per 15A NCAC 02H .1003(5).
2
The provided calculations indicate that the side slopes of the vegetated conveyances are 3:1 (left side) and 2:1
(right side). Per 15A NCAC 02H .1003(2)(c)(i) the side slopes of the vegetated conveyances must be 3:1 or flatter
(or you will need to provide a site specific soil investigation to demonstrate that the soils will remain stable).
Please revise as needed.
Supplement-EZ Form:
o Drainage Area Page:
Line 18 – Per the calculations, the %BUA should be shown as 21% (152,460 sf / 737,950 sf =
20.7% which rounds up to 21% (since the form only shows whole numbered percents)).
o Low-Density Page:
Line 4 – See earlier comment, if multiple side slopes will be used for the vegetated conveyances,
please elaborate in the additional information section (revise if needed).
Line 5 – The calculations indicate a maximum velocity of 10.8 fps (swale 8).
Please provide the following:
1x hard copy & 1x electronic copy of the revised pages of the calculations.
1x hard copy & 1x electronic copy of the revised pages of the Supplement-EZ Form.
2x hard copies of the revised plan sheets (as needed).
1x hard copy (2x hard copies for plan sheets) & 1x electronic copy of anything else needed to address these
comments.
Hard copies should be mailed to me at the following address:
For FedEx/UPS:

Raleigh, NC 27604
For USPS:

Hand Delivery:
Please reach out to me prior to hand delivering a submission to make sure that I (or someone else in my group)
will be able to receive the submission. Do not leave the package in the foyer with the security guard.
NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay the review process and the
submission package may be lost while being sent from the Regional Office to me in the Central Office.
Electronic copies should be uploaded at the following location:
https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload
Since these are really minor things, once I get the hard copies, anything else that may have changed from addressing
these issues, and the documents are uploaded to Laserfiche (Provided everything is still in order), we can issue the
permit without doing another formal review.
Let me know if you have any questions.

Good Morning,
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application
nd
for the subject project on March 2, 2022. A review of that information has determined that the application is not
complete. Attached is a letter describing the items that need to be submitted. If you have any questions, please feel free
to contact me. My contact information is listed below.
As indicated in the comment letter, it appears that the email from our office letting you know that we have accepted the
project for review and instructing you to upload the electronic files for this project was not sent out to you on March 3,
2022 when we accepted this project. Please upload those files at this time at the following link:

Good Afternoon,
We received additional information for the application for a new post-construction stormwater permit on 2/28/2022. At
this time, the submission is not administratively complete and cannot be accepted for review in its current condition.
Please provide the following submittal items by close of business on 3/21/2022 (We do not typically offer extensions to
administrative completeness reviews) so that we may accept the project and begin the review process, otherwise, the
project will be returned as administratively incomplete.
Prior Comment - 1x original signed & sealed hard copy of the Supplement-EZ Form (The form has a low-density
option for low-density projects). This item is required per Section V & VI, 3 of the Application. This form can be
found at the following website: https://deq.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-program/stormwater-design NOTE: This form uses macros to generate the
correct pages, depending on what is entered into the cover page. The complete form should have a cover page,
drainage areas page, and low-density page. The provided form is missing the drainage areas page and the low-
density page. To activate the macros, click “Enable Editing” and “Enable Content” (via pop-up dialogue boxes at
the top of the spreadsheet) and then click on the “Load Supplement-Forms” link on the cover page (below Line
26 and above the Designer Certification box).
Prior Comment - 1x original signed & notarized hard copy of the O&M Agreement Form (The form has a low-
density option for low-density projects). This item is required per Section V & VI,3 of the Application and 15A
5
NCAC 02H .1042(2)(j). This form can be found at the same website as the Supplement-EZ Form and also uses
macros to generate the correct pages. NOTE: You may wish to get a second version of this form notarized for the
Applicant to keep (since the Register of Deeds will require an original for recording).. The low-density option (last
option in the middle of the cover page, right below “User Defined SCM”) must be selected (“Yes”) and the type
of low-density project must be selected (from the dropdown list to the right of “Type:”). As with the
Supplement-EZ Form, this form uses macros that will need to be activated in a similar manner as described
above to generate the required O&M tasks. These must be included as part of the O&M Agreement Form. This
form will need to be re-signed & notarized.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process generally take 30 – 45 calendar days, but can take up to
90 calendar days per statute (one of our two reviewer positions is currently vacant so this review will probably be closer
to 45 days than 30).
Hard copies should be mailed to the following address:

This form can be found at the same website as the Supplement-EZ Form and also uses macros to generate the
correct pages. NOTE: You may wish to get a second version of this form notarized for the Applicant to keep
(since the Register of Deeds will require an original for recording).
1x original signed & notarized hard copy of the deed restriction form. This item is required per Section VI,2 & VII
of the Application and 15A NCAC 02H .1042(2)(k). This form is available at the following location:
https://deq.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater-program/post-
construction-program/post-construction-forms
1x hard copy of calculations for the vegetated conveyances demonstrating that they meet the requirements
outlined in 15A NCAC 02H .1003(2)(c). This item is required per Section VI, 7 of the Application and 15A NCAC
02H .1003(2)(c).
2x signed & sealed hard copies of a plan sheet showing the following:
o Delineated drainage areas to the proposed vegetated conveyances (Required per Section IV, 8o of the
Application and 15A NCAC 02H .1042(2)(g)(iv)). This is required in order to verify the vegetated
conveyance calculations.
o Existing site conditions (Required per Section IV, 8k and 15A NCAC 02H .1042(2)(g)(v)). Plan sheet 4 was
not provided in the submission.
o Wetland delineation or a note on the plans stating that there are no wetlands located on-site (Required
per Section VI, 8m of the Application and 15A NCAC 02H .1042(2)(g)(iii)). Please also list the name of the
individual that made this determination in a note on the plans.
o Detail/typical section for the vegetated conveyances and the roadway (Required per Section IV, 8l of the
Application).
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brough up during the engineering review):
7
While not required to be addressed for administrative completeness, this project does not meet the definition
of a low-density project. The proposed piping network violates the requirement to design the project in a
manner which minimizes the channelization of flow (per 15A NCAC 02H .1003(2)(b)) and has an excessive
amount of non-vegetated conveyances (prohibited per 15A NCAC 02H .1003(2)(c)). It is recommended to either
remove the excessive piping or redesign this project as a high-density project.
