Good Morning,
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application
nd
for the subject project on March 2, 2022. A review of that information has determined that the application is not
complete. Attached is a letter describing the items that need to be submitted. If you have any questions, please feel free
to contact me. My contact information is listed below.
As indicated in the comment letter, it appears that the email from our office letting you know that we have accepted the
project for review and instructing you to upload the electronic files for this project was not sent out to you on March 3,
2022 when we accepted this project. Please upload those files at this time at the following link:
https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload.
Thank you,
Jim Farkas

Good Afternoon,
We received additional information for the application for a new post-construction stormwater permit on 2/28/2022. At
this time, the submission is not administratively complete and cannot be accepted for review in its current condition.
Please provide the following submittal items by close of business on 3/21/2022 (We do not typically offer extensions to
administrative completeness reviews) so that we may accept the project and begin the review process, otherwise, the
project will be returned as administratively incomplete.
- Prior Comment - 1x original signed & sealed hard copy of the Supplement-EZ Form (The form has a low-density
option for low-density projects). This item is required per Section V & VI, 3 of the Application. This form can be
found at the following website: https://deq.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-program/stormwater-design NOTE: This form uses macros to generate the
correct pages, depending on what is entered into the cover page. The complete form should have a cover page,
drainage areas page, and low-density page. The provided form is missing the drainage areas page and the low-
density page. To activate the macros, click “Enable Editing” and “Enable Content” (via pop-up dialogue boxes at
the top of the spreadsheet) and then click on the “Load Supplement-Forms” link on the cover page (below Line
26 and above the Designer Certification box).
- Prior Comment - 1x original signed & notarized hard copy of the O&M Agreement Form (The form has a low-
density option for low-density projects). This item is required per Section V & VI,3 of the Application and 15A
NCAC 02H .1042(2)(j). This form can be found at the same website as the Supplement-EZ Form and also uses
macros to generate the correct pages. NOTE: You may wish to get a second version of this form notarized for the
Applicant to keep (since the Register of Deeds will require an original for recording).. The low-density option (last
option in the middle of the cover page, right below “User Defined SCM”) must be selected (“Yes”) and the type
of low-density project must be selected (from the dropdown list to the right of “Type:”). As with the
Supplement-EZ Form, this form uses macros that will need to be activated in a similar manner as described
above to generate the required O&M tasks. These must be included as part of the O&M Agreement Form. This
form will need to be re-signed & notarized.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process generally take 30 – 45 calendar days, but can take up to
90 calendar days per statute (one of our two reviewer positions is currently vacant so this review will probably be closer
to 45 days than 30).
Hard copies should be mailed to the following address:

Good Afternoon,
We received your application for a new post-construction stormwater permit on 2/17/2022. At this time, the submission
is not administratively complete and cannot be accepted for review in its current condition. Please provide the following
submittal items within 30 calendar days (by close of business on 3/21/2022) so that we may accept the project and

- 1x original signed & sealed hard copy of the Supplement-EZ Form (The form has a low-density option for low-
density projects). This item is required per Section V & VI, 3 of the Application. This form can be found at the
following website: https://deq.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-program/stormwater-design NOTE: This form uses macros to generate the

- 1x original signed & notarized hard copy of the O&M Agreement Form (The form has a low-density option for
low-density projects). This item is required per Section V & VI,3 of the Application and 15A NCAC 02H .1042(2)(j).
This form can be found at the same website as the Supplement-EZ Form and also uses macros to generate the
correct pages. NOTE: You may wish to get a second version of this form notarized for the Applicant to keep
(since the Register of Deeds will require an original for recording).
- 1x original signed & notarized hard copy of the deed restriction form. This item is required per Section VI,2 & VII
of the Application and 15A NCAC 02H .1042(2)(k). This form is available at the following location:
https://deq.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater-program/post-
construction-program/post-construction-forms
- 1x hard copy of calculations for the vegetated conveyances demonstrating that they meet the requirements
outlined in 15A NCAC 02H .1003(2)(c). This item is required per Section VI, 7 of the Application and 15A NCAC
02H .1003(2)(c).
- 2x signed & sealed hard copies of a plan sheet showing the following:
o Delineated drainage areas to the proposed vegetated conveyances (Required per Section IV, 8o of the
Application and 15A NCAC 02H .1042(2)(g)(iv)). This is required in order to verify the vegetated
conveyance calculations.
o Existing site conditions (Required per Section IV, 8k and 15A NCAC 02H .1042(2)(g)(v)). Plan sheet 4 was
not provided in the submission.
o Wetland delineation or a note on the plans stating that there are no wetlands located on-site (Required
per Section VI, 8m of the Application and 15A NCAC 02H .1042(2)(g)(iii)). Please also list the name of the
individual that made this determination in a note on the plans.
o Detail/typical section for the vegetated conveyances and the roadway (Required per Section IV, 8l of the
Application).
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brough up during the engineering review):
- While not required to be addressed for administrative completeness, this project does not meet the definition
of a low-density project. The proposed piping network violates the requirement to design the project in a
manner which minimizes the channelization of flow (per 15A NCAC 02H .1003(2)(b)) and has an excessive
amount of non-vegetated conveyances (prohibited per 15A NCAC 02H .1003(2)(c)). It is recommended to either
remove the excessive piping or redesign this project as a high-density project.
