The original questions/requests are copied below as they appear within letter and are then followed by our response. Additional Information Requested: i. Please provide documentation indicating how you determined whether onsite streams were perennial or intermittent. This determination must be made by the DWQ. The streams were evaluated onsite by S&EC staff utilizing the NCDWQ Stream Classification Form and/or the USACE Stream Quality Assessment Worksheet. However, because this determination must be made by the DWQ, a site visit has been scheduled with Eric Kulz of the Raleigh Regional Office. This site visit is scheduled for October i9, 2006. A summary of this site visit will be provided after October 19th to verify our determinations. 2. Impact $ appears to be at a 60° - 6$° angle. Please redesign this crossing so that the impact angle is between 75° and io5°. Also, this impact leads to `future development". Does this need to be done right away, or can this impact be done when the `future development" begins? Impact g has been redesigned to be more perpendicular, minimizing proposed impacts to the stream, please see the revised Overall Site Plan, revised Location Map 2 & g and revised Impact Map-Crossing 3. The revised PCN Application is also attached which includes the new proposed impacts for Impact g. In addition, with regard to the "future development", this crossing does lead to "future development" however it is a proposed impact well within the property boundaries leading only to future residential development that will need to take place in order for this project to be feasible. Furthermore, because this is a single & complete project, it was our understanding that all known proposed impacts should be applied for initially therefore avoiding any future undefined cumulative impacts. Project imperviousness area listed a 2g.8%. However, calculations/figures are confusing. The calculations attached with the PCN use a site area of 948 acres, but in Section VII of the PCN the site is listed as 314 acres. Please reconcile this discrepancy. Also, the calculations list x,39 lots, but I count i8o lots on the plans. Please reconcile this discrepancy as well. The previously submitted impervious calculations were incorrect; these calculations were for a different project and were inadvertently submitted. Attached are the correct Maximum Potential Impervious Calculations with a total imperviousness of zo.i%. This includes the correct total tract acreage and the correct total build out of all lots. In addition, I have attached a revised PCN Application which includes the correct property size in acres. We anticipate that this answers all of the DWQ's questions in order to complete the final review process fora 401 Water Quality Certification. Describe the overall project in detail, including the type of equipment to be used: The proposed project is for a residential subdivision with impacts resulting from the installation of roads, sanitary sewer force main and an 8'wooden bridge trail, these impacts are necessary for accessing the entire property. Heavy equipment t}~ically used for road construction and excavation will be employed for this project. 11. Explain the purpose of the proposed work: The purpose of the proposed work is to meet the demand of additional housing needed in the area. Proposed impacts to jurisdictional areas are needed in order to gain access to the entire property. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). On July 24, 2004 S&EC conducted a detailed wetland delineation On September 22 2004 Mr Todd Tugwell of the USACE conducted a site visit to verif~iurisdictional wetlands (Action ID 200421535). V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. Although the western portion of the project area indicates "Future Development" the extent of all impacts have been shown and requested within this application. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below.
